Default Vodaphone Contract ended but now more charges!

Hi all,

Just enquiring on behalf of a friend.

He had an 18 month contract with vodaphone which ended 2 months ago as the phone broke towards the end of the contract he signed a new contract with another network and continued to pay the remainding few bills with vodaphone.

As he is quite young he was unawre that he had to give vodaphone notice that once the contract had ended he wanted it cancelled. Instead he just cancelled the direct debit. Since then he received 2 further bills and as he has not paid them it has been passed to a collection agency.

Where does he stand? He does not want to pay this money becuase the contract officially ended 2 months ago.

The contract may have finished but he is still liable if he did not give them notice as it rolls over monthly. This quite clear in the T & Cs. IMHO I suggest gives them notice and he pays them what he owes them.

He has to give 30 days notice to cancel the contract (this is the same for any mobile phone contract). If they have passed it to a debt collection agency it will be affecting his credit file and he may now have a default recorded which will remain for 6 years. His best bet is to phone Vodafone and may it as soon as possible as this may just stop them registering the default but he will probably already have late payments.

His contract NEVER finished. He simply completed the minimum term, it then rolls on until he gives 30 days notice. You say he's 'quite young' - is he under 18? if so the original contract may be invalid as minors cannot apply for or be held to contracts. If he was 18 or over, do warn him that VodaFONE will default him on his credit record without a blink, so it would be best for him to pay what is owned by clearing the arrears, and at the same time give formal notice of termination.
