Default Orange/Moorcroft

For months Moorcroft have been hassling me to clear my account.
If you have read my thread "Orange charging me for a phone i've never had" you will understand my problem.

I paid of "my" Orange account a couple of weeks ago. Now i've just been looking through my credit file and on it the account is closed and has been since 05/09/2007 but Moorcroft have still been chasing me.

Even though i hadn't paid it at that point, I'm thinking it might have been closed due to the problems i have been having and the fact i've never recieved the phone in the first place. They just decided to cancel it

So since i've paid for it after the account has been closed can i claim it back.

Any help would be great

I've done a letter to send to Moorcroft and i would appreciate it if someone could read it and let me know what you think and if i need to change anything/all of it

Dear Sir/Madam

re: xxxxxxxx

I'm writing regarding the above account.

On the 20th May 2008, I paid £xx.xx as full and final settlement of this debt. Since that payment was made i have noticed on my credit file from Equifax that this account was closed on the xx/xx/xx. Yet you've continued to pursue me for this debt.

I require a full refund of £xx.xx to be sent within 7 days or a shall seek remedy from the Financial Ombudsman Service.

I sent the above letter to Moorcroft and recieved a letter back saying it has now been sent back to Orange. Do you think i should write a letter to Orange explaining the situation and ask for a refund.

Would include in the letter that you will contact Otelo (not sure if the FOS can help you as don't think telecommunications companies are regulated by the FOS, but I'm sure someone else will be able to confirm that if I am wrong)

Otelo is simply a dispute resolution service - and funded by he telcos themselves. In essence, since you paid you admitted the debt and the matter is concluded.

The problem is you paid when you shroudn't have, so getting the money back will only happen if Orange accept your statement that you never actually received the phone. If they do, then fine, you should get your money back, however in they eyes of a court, payment = admission, so formal action would not be straightforward to pursue.

I only paid it as Moorcroft wouldn't stop hasseling me. If they rang the company who "gave" me the phone they would know that i never recieved it as it was never signed for. I'll try anyway i have nothing to lose and alot of money to gain
