Default Cancelling a mobile contract within 7 days?

Hi,

We've recently renewed our business mobile phone contracts and chose 2 new handsets (There are 2 of us) which we received last Wednesday. We've used both the phones but the new contract/tariffs etc don't take effect for about 2 weeks.

We haven't signed any new documents for the renewal and all arrangements were made over the phone. Since then we have changed our mind and wish to cancel the contract if possible and return the phones.

On the paperwork we got from Orange its says that if we're not happy with the phones for any reason then they can be returned withing 7 working days, but it doesn't say anything about whether we can cancel the renewal of the contract... But I'm sure I remember reading somewhere that if the renewal was taken out by phone then you have a cooling off period?

Can anyone confirm where we stand on this and whether the contract can be canceled?

Possibly - but the cooling off period almost certainly will not be an AUTOMATIC right, as this is a business(not consumer) transaction. It really depends on the terms of your contract.

With the network there is often NO cooling off period on renewals, certainly if you don't like the HANDSET you can change it within 7 days, but this doesn't affect the contract (which is for mobile service).

Hi

The seven days is your 'cooling off period' if you want to call it that! you have seven working days from the reciept of the phones to cancel the upgrades. Although the new tariffs (if changing) comes into effect on the billing date, the new contract starts when you get your new phones.

you MUST ring into customer services in that 7 day period to let them know you want to cancel, they will also give you the address you have to return the fully boxed up equipment back to (would recomend you send by recorded delivery) They will put a note on your account that you have called to notify of cancelation. they will also put a stop on your new tariff taking effect.

you then reset to how you were before. you can chose 2 other phones or negotiate a further deal etc

I had an Orange phone via Phone4U and was told that if I didn't wan the handset I had 14 days, I had nothing but probs with reception from Orange pile of sh@t so took phone back and the contract was cancelled. However Orange have since sent me a bil for about £12 for calls made on phone. They can whistle for this as the only calls I made I had poor connections and ended up loosing the connections also or couldn't hear the other party.

Lets see them try and enforce this debt.

forgot to mention - it is 7 days from the day after you get delivery/sign for goods, so you would have to ring in before end of Friday, so still time to do it!!

Guys, I think you are missing the whole point that this was not a consumer transaction, but a business one.....therefore the 7 day cooling off periods may not apply, and it is entirely dependant upon the terms of the contract the OP has.

Additionally, you do NOT send anything worth over £33 by 'Recorded Delivery'. If it is not delivered, you are still liable for it and RD only provides minimal (£33) compensation. Special Delivery is the only sensible return method.
