Default T-Mobile contracts

Hope someone can give me a bit of advice

For months i have been trying to find out when my t-mobile contract was coming to an end as I knew it was close. T-mobile have an online site that allows you to check if your phone is eligable for an upgrade (which it is after the 18 month contract comes to an end). Dispite trying week after week it would not let me upgrade so I then sent them a text and on 5th may recieved the following text from them

"Sorry, we are unable to offer you an upgrade at present. For more information please contact customer services."

I did phone them only to find out that the 18 month contract was up on the 27th January. At no point have they provided any details of this and in fact misled me into believing I was still under contract!

They offered me a reduced amount per month which to be honest is more than their new customer on line deal so I have said no. They are now telling me i have to give a months notice to terminate

This all feels very on sided..
I have paid over 3 months more on a contract that was finished and now I have to give a months notice on a contract that had finished.

Do I have any rights folks??

Welcome to CAG, Coffeebean.

Mobile phone service providers don't usually tell you that you are "Out of Contract" so to speak, it is expected that you either keep a note yourself, or; contact the customer services and request the date your agreement matures.

This appears to be industry standard across the board, unless someone would like to correct me of course, that you can give your 28 days notice either 28 days PRIOR to the agreement maturing or 28 days AFTER the agreement came to an end, either way though, you are required to supply 28 days notice, and if the service provider wanted to be really arkward, they can demand you give the 28 days notice in writing also.

Because you have continued to use the phone service supplied for a further 3 month AFTER the end of the agreement date, you continued to use the phone no doubt? so you were on a rolling contract.

Also it would be the same as if, when the agreement came to an end if the phone company just cut you off saying "It was the end of the contract" you'd be pretty upset of the sudden disconnection if you hadn't requested it.

Best thing now, would be to give them the 28 days notice (Request the Porting Authorisation Code if required) then go else where.

Er no! Your contract never 'finished' you only completed the minimum term, which is a completely different thing. Once you have completed your minimum commitment you can give notice of your intention to terminate. The fact an 'upgrade' wasn't available to you at the date of the contract anniversary is a matter only for T-Mobile, as they don;t fall over themselves to provide upgrade handsets if they've not made enough money from you.

Upgrading simply means taking out a fresh agreement and another lock-in for 18 or 24 months. If the phone you have still works, I'd suggest the pragmatic approach is best - you're now in the position that you can tell the network to stuff it with just 30 days notice (from your next billing date). Many users would kill to be in that position...

for future reference if you text UP to 150 it is far more reliable.. alternatively call and ask customer services or pop into store.

T-Mobile dont badger people to upgrade, it is often an unwelcome call and also not great business sense

If you speak to someone in the upgrade department, rather than lose your custom they can and will match the deal for a new customer
