Default Rainbow mobile MSOL ltd

Hi,

I took out a cashback deal with 3 through rainbow mobile and sent my first cashback claim in November special delivery, it was received in time and I have the record. However I never received an e-mail acknowledgement (as they said they would) and the cash back was due on the 11th jan but I've heard nothing.

I know these guys are in trouble judging by the amount of bad press they're getting, and a few ppl are issuing proceedings for full cashback amoutn due to breach of contract.

I've tried countless times to contact them by phone but I never get through (always engaged). I too now want to issue proceedings but not sure how I progress.

1. Do I have to warn them of my intention 1st? (i.e letter before action). If so are there any existing templates out there I can use?
2. Do I actually need to have spoken to someone first to resolve this? (a near impossibilty, God knows how other ppl get through).
3. Anyone got the name and address of the person I direct teh LBA and following court claim to please?
4. Any other advice? (Have haerd MSOL ltd had stopped trading, but then couldn't find out if that ws the case or not).

I'll start the ball rolling, I'm sure other will come along shortly.

1. Yes, 2 goes at resolving this (by letter) and then you can issue proceeding if you wish. As for the letter, letter 1 should be an initial request for resolution, outline your problem and how you want it resolved. 14 days for them to respond. Letter 2, basically the same, but more insistant, and a definate 14 day deadline before court action, which will include the usual. something like this

'I require payment in full of this money. If you do not comply fully within 14 days then I shall begin a claim against you for the full amount plus interest plus my costs and without further notice.'

letters sent recorded delivery and check they have been signed for.

2. Do not speak to anyone, conduct everything in writing, recorded delivery. If they telephone, politely refuse to discuss it and ask for it in writing, unless you have call recording facilities and know the legal requirements for using it.


3. Send it to head office. I couldn't find rainbo mobile with a google search, is it mobile rainbow? you should have some correspondance from them, find the address from that.


4. learn as much about what your about to do as possible, you have basically 28 days before threatened court action. Read as many threads as you can that have a connection with the problem, it's very important you do some research into this, it will pay dividends later.
