Default Vodafone Outstanding bill

Hi everyone, first time I have posted. I need and answer to a little problem i have. I have an outstanding bill of over £400 due to Vodafone which has been referred to a debt collection agency called Credit Solutions. The other day i got a phone call from them and was willing to set up a payment plan of £40 per month.
They have told me that what they want is for me to send a copy of my wage slip and a note of all my outgoings so they can see how much I can afford. Are they able to do this? I was under the impression that as long as i was willing to pay the money back that should have been enough. They have refused to set up a payment plan for me until they have this information. I dont really fancy having a copy of my wage slip sent through the post either. What should I do next?

Firstly, do not send them anything, you don't have to.

Second, do not speak to them on the phone ever, and insist on all future communication in writing.

Third, never sign anything you send, just type your name.

OK, so thats the beginning.

The next thing is to have a good read about CCA requests. The real basics are that a consumer credit act agreement is the form that needs to be signed when credit (most credit) is taken. If this is not done correctly, you are in a very strong position.

it really will help to look at peoples threads and experiences. I know it's a lot of reading, but if you can spare the time it will pay dividends in the end.

There will be lots of help, but it would be invaluable if you get a good understanding yourself of whats involved.

It's a lot to take in in one go, but good luck with it.

I have had a quick read of what you have sent me louis and thank you very much. I havent had to sign anything and have no intention of signing anything. I received a letter from them las week with a legal notice saying: Our client (Vodafone) is not prepared for this sum to remain oustanding any longer, and unless payment is made to Credit Solutions within 7 days from the date of this letter, court proceedings may be commenced agaunst you without further warning or notice. Legal acttion would result in further charges being added to your account as follows; Solicitors Costs £50 Court Fee £50.

If you wish to discuss the contents of this letter or to make proposals for the settlement of this debt, please call us.

Please do not simply write as our time limits are now very strict.

Is this debt still owed to Vodafone or is it Credit Solutions' problem now?

I just really want to know if they can refuse me a payment plan until i send them a copy of my wage slip and a list of my outgoings. I would love to tell them I am doing nothing because their attitude stinks. Is it any different seeing as I live in Scotland as I know sometimes Scottish law can be different.

i am not sure about the wage slip, but it doesn't sound right.

Neither does anything in bold. You must be given time to discuss your debt (if indeed there is one) and come up with a plan.

Have a read of this, I don't know if it applies to scottish law, but I'm sure the basics must be at least silmilar.

In short, they are trying it on. I'm sure a CCA expert will be able to give specific advice, but at the moment, all they are doing is trying it on. It's out of order, and there are things that can be done.
