Unhappy Mis-sold Orange contract - help!

Hi, my husband and I both took out 12 month contracts with Orange (both under hubbies name) a year ago through an agent. We absolutely and without doubt were sold 12 month contracts by the agent. Now we have decided to move to pay as you go (as the 12 months is over) and have been told by Orange that one (only one!) of the contracts is actually for 24 months! This was a verbal contract with the agent and this was not done over the phone so we have no proof of the misrepresentation. What should we do??!!

The agent is denying everything and says he has no record of what contract we should have and is basically blaming Orange and saying we should speak them. Orange are insisting this should be dealt with through the agent. :o
Any thoughts appreciated.

Hi barracad. No we didn't sign any paperwork, basically Orange are saying that this is a verbal contract. Therefore they have no proof of the contract (although I suspect that if pressed they might be able to find record of a conversation with the agent but nothing with us personally) and we have no proof of the misrep.

To take out any kind of NEW contract you would have had to been through a credit/identity check, also as was a new contract a Customer Information Form (CIF) form would have had to be signed.
The dealer or agent may well have instructed Orange verbally over the phone in setting it all up, but you say your dealings with the agent were not done over the phone? If the agent didnt give you a copy of the CIF, they will have one, as they have got to keep it for reporting purposes!

I would chase the dealer again and request a copy of the CIF to be sent to you asap.

You dont say the package/tariff you are both on.....are they individual talk plans? did you have any specific special offers?
you can mail me with more details of the tariff/plan if dont want to put too much detail on open forum. cant promise anything but may be able to help make some sense out of it!

So you signed up with an agent in a store, I assume? Can you give a little more background - usually you either take out a contract over the phone, and the call is recorded, or you do it in person and have to sign paperwork.
