Unhappy sky

i opened a sky account in feb this tear(2007).my tv was installed the the broadband went active a few days after.my phone service was never swapped to sky (with no explanation why).two days after my broadband was connected it stopped working. i gave them a month to fix it but they failed. now they will not let me cancel because they said its a 12 month contract.

am i right in thinking that the supply and services act 1994 applys to this becausethe failed to supply 2 out of the 3 services i asked for.They are just about to pass this to DEBT RECOVERY AGENCIE.why i dont know because its there fault as far as i can see.

PLEASE HELP

From memory, you cannot get out of the contract due to an inability to supply any service. (Honestly!) however, you don;t have to pay them for a service they don't supply, so you MUST pay them for services received, and deduct anything you've not used. If a DCA gets involved just say the service was not provided to your satisfaction and the debt is disputed. They then have to pass it back to Sky.

Hopefully, you reported the lack of service as a fault? As you have to let them fix it. If a service was never provisioned (doe to their error) they still must rectify this, or if you wish to cancel - give them 21 days to complete the agreement or you will demand cancellation.

That part doesn't matter - unfortunately. You can 'sign up' just by ticking a box when requesting service, or making a payment - this is seen as agreeing to any Terms & Conditions of the arrangement.
