I understand that, but surely we are still at freedom to have a guess as to what their next action will be? YOUR communications may be under the veil of secrecy, but *I* can muse and extrapolate still to my heart's content, can I not? You wouldn't be bnockering me about, by any chance?

The point I was trying to make was that IF they were thinking of raising a claim against you, you got in there first, so you could then get their claim thrown out since the dispute is already subject to your own legal action, right? Or they can counterclaim, but for what? They owe YOU, and the return of the items is not in dispute either once they give you your money back...

I'm confused.

I've been threatened with court action by skillstrain!! They are obviously watching so i've removed my previous post. Trading Standards are now dealing with my problem, so i'll just leave it up to them.

What are they threatening court action for? If it is for what I think, then you can PM me with the answer instead...my 'moderated' and 'restricted' posts since hearing from Eversheds should give a clue to my own reasons for non-belligerence of late...

Nothing in the post today, but after coming home I did have an email waiting for me from Eversheds.

They have offered 40% of my claim total, and are sending a hard copy of the letter, plus cheque, in the post. As there are no conditions of acceptance attached to the offer then I am duty bound to accept the proffered sum...in part-settlement.

Eversheds have been advised that my claim continues whilst the balance remains unsettled, and that once this has been cleared then my claim will be withdrawn.

A good day methinks...

...an interesting development. 60 seconds after emailing my response to Eversheds, I was 'copied in' on an email between Eversheds and Ringpowersolutions, discussing my claim.

Being the Spice that I am, I had to respond, and enquire as to the context of a third party company being party to private and confidential communications between myself and Eversheds...and I await a response with interest.

I also need to consider the implications in context of data sharing, contrary to my instruction to Skillstrain, and in blatant breach of the Data Protection Act...
