Default Unsigned Forms

Hi

I did a DCA letter to SLC. They returned one but it didn't have the same reference to the loan I was enquiring about (it probably did refer to one of the - I think I had three) and also it wasn't signed by anyone at SLC. I think I read somewhere that this makes it invalid or something. Is this true?

Hang onto that - yes, it's true - an agreement needs to be signed by both parties to be legally enforceable.

Any suggestion on how I should proceed?

If I reply and say, 'hang on, this form isn't signed' surely they can just sign the original and send me another copy!

Sounds familiar - exactly the same happened to me! One minute it's unsigned, the next copy the send is miraculously signed!!

Unfortunately they did send it within the timescale - just not a signed one. I shall have to write back and demand a signed one. Surely they'll have to get someone to back date a signature?

no, they haven't complied within the timescales because they have not sent a compliant CCA.

if they then sign, they are very naughty.

that's really helpful - ta. I'll write back to advise them of their error. I might even cancel my direct debit until they provide me with the correct document.
