Old Style Vs New Style (and arrears)

I took out a loan in 97 and one in 98. I know the 97 one is covered by the CCA but is the 98 one also covered?

The 98 repayments never came directly out of my wages, I had to pay them via direct debit until i deferred.

Now I'm being chased by a collection agency and wanted to know if both my loans are covered by the CCA.

I suspect the amount the agency are chasing me for are 'arrears' i.e not part of the actual loan but charges from the SLC.

Is it possible to still owe the SLC money and have a collection agency chase for arrears? Or should the amount the agency are chasing me for be the total amount I owe (which is roughly the amount I borrowed in the first place).

My OH has a loan from 2000, he has arrears due to an admin error made by SLC.

SLC have tried to default the whole amount loan and arrears and thats now what theyre after.

So they're now after 2 large sums of money? The original loan amount and these arrears? What are the arrears for? Just missing payments?

I've no problem paying back the loan, I borrowed it. But surely the arrears are against the law?

the arrears are disputed as it was for several months when he had deffered the loan due to unemployment the SLC said they didnt receive the forms.
But they didnt tell him this until about 8 months later and had no letters from them in the process.
They admit they do not acknowledge any correspondence unless it is sent recorded. He has spoken to them on the phone so many times since 2006 its untrue but they keep saying the same thing that they know nothing and he owes this money.
We have CCA and hopefully we can S.A.R - (Subject Access Request) as well but we are running against the clock a little.
