Default Honours Student Loans and Illegible Loan Agreements

Hi All,

I am in the process of trying to have a CCJ set-aside, the full story below if you are interested. But it isn’t really relevant to this enquiry.

CCJ and the Liverpool Postal Strike

After multiple requests, they have now sent me alleged copies of the loan agreements. In my opinion they are illegible – only some of the words can be read.

The thing is the original loan was with Student Loans Co, who allegedly sold the debt to Honours Student Loans.

What is the track record of Student Loans Co or HSL on producing legible copies of loan agreements?

They have also failed to produce any evidence of the debt being transferred to them from SLC. Is this required to prove entitlement?

They have also asked that I acknowledge receipt of the loan agreements. Should I do this? I am guessing I shoudl acknowledge receipt of some illegible documents.

Any thoughts?

Hi Blurred. Could you, if at all possible, post any documentation you received on here - maybe via Photobucket - and I'm sure someone will take a look at them for you. If they don't meet strictly required terms they may not be enforcable.

Deb, I have taken your advice and below is a link to the documents. Where can I find out about the criteria it must meet? The scan is representative of the agreement - it really is illegible!

Hey Blurred - man, that is a bad copy isn't it! It's even worse than the one I got. Let me do a little looking around and find the information on the criteria it should meet and then I'll post a link on here for you but on first sight I would say it's totally illegible and therefore unenforcable. Anybody else please jump in here if they have any further advice.

The Consumer Credit (Cancellation Notices and Copies of Documents) Regulations 1983 SI No. 1557

Legibility of notices and copy documents and wording of prescribed Forms
2.-(1) The lettering in every notice in a Form prescribed by these Regulations and in every copy of an executed agreement, security instrument or other document referred to in the Act and delivered or sent to a debtor, hirer or surety under any provision of the Act shall, apart from any signature, be easily legible and of a colour which is readily distinguishable from the colour of the paper

Sorry for hijacking ur thread,

I have seen ur uploaded pic of ur agreement from SLC, I too have just recieved a copy of my CCA from SLC, which is identical to yours apart from mine is a little more readable.

But I have recieved 2 copies of the same agreement (duplicate), the only difference is that in the box marked FOR OFFICIAL USE ONLY there is a signature and it is dated in one copy, and in the other copy there is no signature or date, apart from that all other facts on the two documents are identical. The boxes that have my signature and date are absolutley identical ( meaning that one document is a photocopy of the other document NOT two seperate signatures and dates)

Could this mean that the SLC have forged a signature in the FOR OFFICIAL USE ONLY box?
Why would the SLC send me two almost identical copies of the same document but with one ducument without an official signature and date and the other document with an official signature and date?

Also in Blurred's upload document is it a proper copy of a CCA ( ignoring the poor quality of the document)? OR is it a poor attempt by the SLC to make the document look like a CCA ?

I would suggest it was originally a legitimate CCA Agreement, but a very bad copy.
