Default Student Loan Arrears

Hello, ive stolen my sister's identity to post this. she posted about my problems a few weeks ago but i really could do with some more help.

I deferred my loans last year and to be honest have no idea whether they sent something confirming this or not, however the first thing I knew about non deferment was when a debt collection agency contacted me in August about arrears for Dec 06 to now. I've since sent a new deferment form which they've accepted but only backdated 3 months.

So... according to the debt collection agency and the student loans company I still owe for 6 months of arrears plus charges. I don't work so have no income and the debt collection agency are now threatening legal action and bankruptcy charges unless I pay the arrears of £770 pounds plus £30 charges which I have no means of doing. The minimum settlement they'll agree to is £111 a month which would have been the normal loan payment.

What should I do?

First off, read the site FAQs.

Then send them a Subject Access Request (enclosing a £10 postal order to cover the fee.)

This is to get hold of all the data they hold on you, from which you can deduce what has happened and how much in penalties they have stung you for, and how much your claim for the removal of the penalties will be.

Then have a good read of as many threads as you can. Sending a CCA s.77 request would be a good idea to shut them up for a while.

Did you defer for this year?

If you are on benefits send some proof of that to show you are taking the situation seriously, but enclose a letter stating that you dispute the total amount as you believe it contains unlawful and unenforceable penalty charges.

Dont discuss anything on the phone, tell them you will only comunicate in writing or email.

Is the DCA called NCO Europe , by any chance?

It's only old style student loans taht are covered by the CCA - when were you a student?
