So smile have not replied to my letter requesting my £3,052 in bank charges over the last six years. Now is the time to threaten them with court action.

Is this the point where I use the template and add the 8% interest, and send that to them as well as to the county court, or do I stick to the original amount?

Stick to the original amount until you actually issue a moneyclaim in court. I assume you have not yet sent the LBA so send that now and when the 14 days is up issue MCOL and include the 8%.

Smile settled my claim for about £300 this morning, I sent the LBA on the 8/11/06 so in my case at least they are responding quickly.

That's right, I'm at the stage of sending the LBA, so I'll hang fire on the 8%.

The 8% ONLY comes into effect when a claim is issued as it's at the discretion of the court.
