Default Smile, any luck??

Firstly may I just say this website is simply outstanding. I am attempting to claim back £350 from Smile (from daily excess charges and service charges) and wondering if anyone knows of any successes of this??

I sent the standard preliminary letter over a month ago, then got the general reply saying the bank charges were as I agreed to in the t's and c's, and therefore perfectly legal (of course)

I then sent the 'letter before action' over 14 days ago. I received a secure messsage back saying they have escalated it to a manager and will get back to me in 7 days. Both time frames have now lapsed, so it is time for me to start the court action technically.....

I notice from another thread, one user (matlow) was successful in getting his/her money back from the same sort of Smile charges and said they didn't even need to go to the small claims court.

I have today sent them one final secure message giving them until Wednesday 19th April to pay up or i'm starting the court claim (which strictly speaking I didn't need to do since I had already given them 14 days timeframe) but I was inspired by the fact that matlow did not have to get as far as the court process.

I would love to hear from anyone who knows of any successes with Smile, and at what stage they coughed up with the refund??? And any tip/tactics that you have found that can help?

ps If I do manage to get my charges back I would love to make a contribution to the funds since I couldn't have even attempted to do it without you people.

I have retreived charges from Smile.

I did have to start proceedings to spur them into action though.

Quite nice actually; we went to the Isle of Wight for the weekend and when we came back, the cheque was on the door matt. Paid for the whole weekend.

Wow, that has inspired me! I could do with a free holiday!

Right then, first thing Thursday morning if i've not got the money back i'm going to moneyclaim.gov.uk to start the claim. I'll keep the site posted with how I get on....

I received a secure message yesterday evening saying sorry for the delay and thank you for giving them a further opportunity to resolve the matter (ie without going to court) and a refund of £350 has now been returned.
Good luck to everyone else trying to claim back!
