Boy am I glad I found this forum! Going to give it a go!

Just want to make sure i've got all my ducks in a row.

I got charged by the bank for monthly subscription service which put me over my overdraft limit. I didn't get any letter or email or anything informing of this and they happily charged me £5 a day until I noticed a month later! They charged me £15 service charge and £155 daily excess charge! The fees didn't stop as i couldn't afford it and ended up overdrawn and a further £95 down because of it.

I spoke to them on the phone about this but it was pretty pointless to be honest.

What I have done now is print out all the statements and underlined the fees which i thought were unfair. I've printed out the preliminary letter and am ready to post it all off!

Just want to make sure that I'm sending the right stuff. Should I be sending the preliminary letter or something else first? I read through everything but not too sure.

Also what address should I send it to??

Also if they refund the money and I still owe money in my overdraft are they likely to close the account and send debt collectors?

Smile refunded my charges closed my account without any intimation and passed it over to debt collectors.

If you have all the information you need that is fine. If not you could send a Subject Access Request - (Subject Access Request) (Subject Access Request) and £10 if you don't have everything.

Also what address should I send it to?? Check out sticky at the top of the smile forum for contact details.

Some people have had this problem with smile, but there usually seem to have been other issues as well. The money is likely to go into your account, but for most people there does not seem to have been a problem. Read peoples threads and you will get a feel for how things have gone. On the whole smile have been much more accommodating than most banks. It is worth opening a parachute account to be on the safe side.
