Written by John Kruse, one of the leading experts on Bailiff Law, this consumer friendly guide is essential reading for anyone who comes into contact with a bailiff.
The book is easy to understand and clearly explains the rights
a bailiff has, and also what they cannot do when collecting debts and repossessing goods etc.
I`m claiming for two different accounts on seperate claims from A&L. The first account total is £1270.70, the second is £868.41. I started with MCOL on the 22/05/07 after getting the usual pathetic offers and many letters refusing my claims. On the 1st june I received a letter from (toe) Wragge & Co enclosing Acknowledgement of service giving notice to claim, then on 8th June received 6 page defence from Wragge & Co. It mentions on section 9 Insufficent Particulars of Claim and mentions about proof etc, similar to what a lot of you have been getting.
I`ve not heard anything else from either MCOL or (Toe) Wragge & Co, just wondered if I should have sent a copy of charges to Wragges although they have claim numbers from MCOL, or do I just sit tight and wait for a court date. Ive checked MCOL and it just says defend 22/05/07.
Please could anyone clarify if I need to do anything else, also I used the calculator to calculate the 8% interest upto the date claimed and put this on my MCOL claims, is this right or have I made a slight boo boo.
that all looks ok - just keep reading FAQ and step by step instructions.
I have sent a copy of the last schedule with the 8% to A&L / the court and now Wragges as I have seen them use this as a delaying tactic on other threads - so I am sure it will not do any harm to send it.
Then if they make any offers you know they have the facts in front of them ( see my thread)
hi jimmyowl77 -
I have just read through your thread, and notice you did your 8% interest with your calculator.
Did you add a 'blanket' 8% to the whole figure, or did you prepare a spreadsheet.
it sounds like you have done the same thing as me.
I itemised all the charges Alliance made on a 'long' list, and then just added 8% interest to the final total with my calculator.
I later found out - that you need to prepare a spreadsheet, and interest will be calcualted on a DAILY basis from the date the charge was debited. Obviously - The further back the charge the larger the amount of interest will have accrued.
You may be very pleasantly surprised at how much interest you have gained for yourself.
You need to visit the Library on here, and search out the Spreadsheet templates. I used the Microsoft Excel - simple version. (because I'm quite a novice with computers - and it was very easy to use)
You insert the actual charge, the amount, date incurred, and it calculates the interest for you, and then by magic - it adds it all up ! ! !
hopefully adding a lot more money to your claim jimmyowl
Please forgive me if you knew this already....
You see I have only just found out and I'm gleefully passing the word on.
I submitted my claim on line, so was unable to submit a substantial particulars of claim, and
Wragge and Co are saying Insufficient Particulars of Claim in their Defence
although they are sending this same document to everyone.
so Seeing as I have to amend my figures, I am now gong to amend my Particulars of Claim with Forms N1 and N244 at the same time.
Two birds with one stone !
Thanks Alice , Luickily I did use the spreadsheet so each charge has a different interest amount. I think it was only by pure fluke that I did this but thanks for replying as its put my mind at rest and hopefully others starting out who your reply will see how to go about it.
Good luck
Does anyone know what I should put in the covering letter to Toe Wragge & CO when sending a copy of charges that A&L owe, looked all over on threads and library put can`t seem to find one? .

Just do a simple letter with your name v. A&L and claim no. as the title, saying you are in receipt of their defence dated ........ and herewith enclose your charges spreadsheet to include interest which you've previously sent to A&L and the court. You trust this now clarifies your claim, etc
Hello, does anyone have Wragge and Co address handy as I`m at work and the only one I can find on tinterweb is for Birmingham, I`m sure my letters from them came from Cardiff .

Could just be me though
I've only ever dealt with their address in Birmingham, which is :-
Wragge & Co LLP.,
55 Colmore Row,
Birmingham,
B3 2AS
You've probably got this anyway if you've been on the internet though. You could always ring them to find out if they've got an address in Cardiff
