That this House notes with concern the exorbitant costs to customers of default charges applied to current and credit card accounts, which cause distress and alarm to consumers, and in particular to the financially vulnerable; welcomes the statement by the Office of Fair Trading (OFT) that a default charge should only be used to recover certain limited administrative costs; recognises the work by Which? to challenge excessive bank charges; commends the thousands of consumers who have challenged these default charges with their providers, many using the free information made available from Which?; and calls on current account and credit card providers to respond positively to OFT's statement.

I've just written to my MP to ask why he hasn't signed it yet and to fill him in on the details of the problem. Perhaps we should all be doing this where our MP isn't on the list.

My MP has passed my concerns on to Alistair Darling, but had this to say (my highlighting): -
'Although these charges might be considered unfair, I think that banks do need to make a charge to cover the administrative costs they incur when their customers are overdrawn. I also believe that bank charges can act as an incentive for people to manage their finances responsibly, which is very important in the current climate of rising personal debt. This is a very delicate issue and one that should be carefully considered.'
I'll be putting him straight on this later!

Advice given is purely my opinion, and is not based on any legal training.
I have spoken today to my local MP's office to ask why she has not signed the Early Day Motion as decribed above. I was told that government ministers cannot sign Early Day Motions at all, regardless if they are junior or senior ministers.
I was also told that if you are getting "stone walled" by the banks that you can also put your case through your local MP for support. I was also told that if this happens the MP would (depends on your MP'd view) write directly to the banks CEO and fight your case on behalf.
My MP's office sounded really positive and willing to help once they have received the full statement from the OFT.
I hope that other MP's will offer this help to any of you that require it.
I wrote to our local MP, Laura Moffat, who has just replied, as follows:
"I share your concerns about the way these institutions extract money from their customers and the appalling consequences they can have for people. I have accordingly written to Margaret Hodge MP, Minister of State at the Department of Trade and Industry, to find out her views and what she is doing. I shall write to you again when I hear further."
