    Question ** WON ** About to start any advice offered is much appreciated

    Hi All,

    First off a big thanks to those who have formed CAGicon and BAG.

    I have been reading through the threads and can only wish all those holding Barclaysicon to account the best of British, and hopefully you will wish me the same as I am about to join your ranks.

    Any advice here would be useful, I am looking at taking Barclays, Barclaycard Visa, BarclayCard Mastercard and MBNAicon through this process and was wondering if I should do them all at the same time or one at once. I must also ,emtion that I am currently getting advice from the CCCS with regard to outstanding debts and whether or not I should be pursuing this at this time.

    Hi and Welcome

    The best advice I can give you is to read around the site especially the FAQ's .This will give you a clear understanding of what you are about to take on and also what to expect in reply to each step you take.As for if you should take them all on at once that would depend on your own circumstances in so much as have you the time , commitment and in a financial position to start paying the court fees (you may be exempt from these ) if not then you can stagger the claims at a pace that best suits you.When you decide to start each claim then post a thread under each banks own forum and use this to update and if you can't find the answer to any question you have already searched for.

    Just to let you all know, I popped into the local branch today and have asked for my statements going back to the opening of the account. They are providing these at a £5 charge, however as this will take me over the overdrafticon limit they will also charge me a £35 fee for that. anyway will keep you all posted on what happens next

    before dla to head office I had asked for statements at my local branch, they charged me £5 for this and was told I would have them in 3-4 days. Now a week later and I am still waiting. I think they are now in a right cafuffle to quote little britains Andy.

    They may be using delaying tactics - send the SARicon letter from the libary include the £10 .

    Just received my DPA back from Barclaysicon and they seem to have changed the wording

    I have pasted the text in below from a scan I did of the letter

    Please be aware that the Bank is not under an obligation to present information according to any particular format. Therefore, your request to assemble a schedule of charges is turned aside. You may of course obtain this data from copy statements and these will be supplied to you shortly without charge on this occasion. As the Bank is providing the copy statements on a complimentary basis, no payment will be will debited from your account.
    As regards your mention of “manual intervention”, the DPA does not oblige the Bank to comment about internal policies and procedures. Furthermore, in the context of managing day to day transactions arising from out of order accounts, the Bank does not hold the information you have requested in a form that would be covered by the DPA. Whilst aggregated information is retained for statistical purposes, this would not constitute “personal dataicon” under the DPA and therefore would not be covered by a s.7 DPA Subject access requesticon. For the avoidance of doubt, the fact that we do not generally record information in a way that is caught by the provisions of the DPA, is in no way an admission that there was no such manual intervention.

    Did you send the DPAR from our libary or did you change the wording ?

    was from the library, no wording changed apart from stating they had permission to withdraw from my account instead of including the cheque

    I used the letter from the library also,and sent £10 which was (obiviously sent back with the letter)
    Ive no idea if this is a standard letter or slight change to the normal reply of request of charges.Am excitedly awaiting a moderator reply to enlighten me.

    Yes, this is a standard letter. The manual intervention stuff isn't really that important anyway; but if you really want it you could write back and tell them that manual interventions into your account are recorded in the Notes on that account which ARE personal dataicon and ARE stored in a relevant filing system - you will therefore accept a schedule of the notes against your account which should include dates and times and the action taken or the discussion referred to.

    The main thing is to get your transactional data and count how much money they have taken from you unlawfully.

    If its not grossly important I will not pursue that part and await my list of charges and continue from there, am a little nervous about all this so dont want to bog my self down in more bank jargo than I require.

    Received another letter from Barclaysicon today, with yet another copy of statements.... however on looking at these they seem to contain more charges than the original set I received.

    Do I know send a further letter claiming the difference or do I send one which withdraws the first letter and claims the full amount?
