    Default Carr v HSBC

    HI,

    Love the site and the forum, cant wait to see what happens with my claim.

    I am hopefully trying to claim on 3 accounts, 2 which have been closed (within 6 months) and 1 that is open, is it possible to claim on a closed account.

    Also I sent DPA to them, they cashed processed the cheque, and I also received a credit on my account with the words "per post" has anyone else had anything like this, the per post credit was for £10.00.

    Yes you can claim on closed accounts, just like an open account. Same process.

    Some banks will accept it as a payment into your account, simply because they don't have a process to cash in DPA request money. basically you are getting it free.

    I have recevied today standard letter we are looking into this for you.

    Bit concerned about HSBCicon not always complying to DPA request, so will wait and see

    Also suprised that the survey shows 5 days average turn around for DPA, mine has been 13 working days so far, I am getting 3 accounts worth of data though and I will feel for the postie

    I have had to chase again, as still no statements, (25/05 requested), I spoke to a lady on the standrad 08457 number and she said they had been sent to the local branch, so I questioned why I hadnt been told this on the last 3 calls, she then put me on hold said she was going to call the branch to check if they were there, and she came back and said they werent but she would send a request to the local branch to get them to print them off, and I would get a call baout it, I advised if no call by Monday I will chase again, I also advised her that I have given 40 days for them to supply or I will take this further.

    I feel as though I am being messed around with HSBCicon, even though First Direct sent all within 5 days. it seems strange that one half of the same company works more efficiently than the other half.

    finally received a batch of statements yesterday all in indivdual envelopes about 40 in total, i then checked it all and thought all the statements were there, so filled out and sent first letter caliming back money, have today received another 26 letters, when I get home will calculate how much is on these, do you think it is alright to send another letter claiming additional monies on the same accounts.

    resend your ammended preliminary letter, with the new amount on but dont restart your 14 days, stick to your original timetable

    I dont know what HSBCicon are up to, but i haven received now 3 sets of statements, and no response to 1st 14 days letter, so I am a bit unsure whether or not they are actually dealing with the request properly, the letter was sent on the 6th received on the 7th of july, so will send 2nd letter on 21st.

    I have spoken to bank about mulitple statements, and they keep assuring me that they have stopped them but all they keep doing is sending them. Also advised them over the phone what I am doing and that they have until 21st to respond to my letter.

    I do have proof of posting and electronic signatureicon verified from royalmail site.

    Is there anything else I can do.

    i'd just sit tight and wait until you can send the lbaicon. I had a standard response to my prelim 15 days after it was received! so sent my LBA and have heard nothing so am in the process of filing my MCOL.

    sent second letter on Friday and received response today, thay have offered 70% of claim, I want to respond with I accept in part,but still want all monies. But cant find a template, is there such a thing or do I do nothing and wait for the 14 days and then do next stage.

    I have checked my letter that was sent to them and it was the lbaicon letter and they offered the 70% on this as "Full and finalicon", is there a standard reponse, advising i accept this but want the rest within 14 days, or do I go straight to money claim.

    29/09/06 - Cheque arrives, FOR SOMEBODY ELSE!! with all their account details in a letter adressed to me!!!
    29/09/06 - HSBC refuse to pay money back into my account
