    Default Request for T&C's in Bank templates Also "The Westminster" NOT Natwest T&C's 1968

    The Request for Repayment Letter that I sent on 9th May didn't have the following paragraph in it.

    If you dispute that I am entitled to a refund of these charges, I request that you forward within the above mentioned time scale, a copy of the terms and conditionsicon that were in force at the time my account was opened, and any subsequent amendments to those terms and conditionsicon. These are requested under CPR Pre-Action Protocol 4.6(c), and failure to provide them will be brought to the attention of the court, should it be necessary to commence a county courticon action.

    I've added it to the lbaicon instead of the reminder that I asked for it in the previous letter, is this the right thing to do? If they don't send them what chance do I have of finding some T & C's from circa 1968?

    I don't know the exact date I opened this account and Natwesticon haven't replied to my request for this or any other information.

    You will have a problem with Natwesticon terms and conditionsicon from 1968 because NatWest bank did not exist in 1968. so good luck on that one as i would be interested if they could respond to that request.

    Thanks Meldrew but I did actually say circa 1968 and you took the wrong end of the bank/date stick. I'm certain it was 1968 because I opened it when I was 18 as my first current account.

    Having my memory jogged the account was definitely opened at The Westminster Bank (Dad had banked there for years) before the Natwest was formed.

    They should easily respond to my request as it is for T&C's at the time the account was opened, the onus being on them to know the date the account was opened.

    Having said all that what are the chances, anyone, of T&C's from The Westminster Bank circa 1968?

    I assume you agree to include the request in the lbaicon though!

    I think it is possible in my opinion to get them in theory. In practice am not 100% certain unless it was mass printed as they are now for the general public.

    OK, here's another point:

    Do I need T&C's from 1968 with "The Westminster Bank" or from 1970 with Natwesticon?

    Could it be argued that a new account was created at a brand new bank when The Natwest was formed?

    I'm sure I would actually need the ones for The Westminster Bank as they were in effect the ones I signed.
