Are you sure you are lba stage? Have you sent prelim letter asking for charges back
The overdraft interest is calculated from the interest you have been charged. But only the portion that relates directly to charges imposed not all of it. It is quite complex to work out but can be done by using the advanced spreadshhet in the templates library.
Do not include 8% at this stage as this is not added until you get to court.
It is important that you follow the steps and guidelines on this site
yes take note of trucker. It might be best for you to describe step by step what you have done, include date and what letters you sent and what templates you used
Yes i have sent the letter asking for my charges back, and was sent what seems to be a standard letter back saying 'sorry to hear you are unhappy............we will try to rectify it within 4 weeks when we give you an update, but the process may take around 8 weeks although endoevering to fix it asap. The usual spiel.
So having trawled the forum it seems the lba is the next step to take, or am i jumping the gun a little?
Nice 1 wigan. Yes the next step is lba assuming of course you have allowed 14 days from them receiving your original letter. Did you include schedule of charges with your original letter?
Well if you've sent the preliminary letter and the 14 days have passed the yes you now need to send the L.B.A., ignore the fact that the bank is requesting 4 weeks, this is your claim so you set the deadlines.
As for the 8%, you can only claim this upon submitting your claim through the courts, so not this stage yet!!

I've been set to issue a court claim against Barclays due to them completely ignoring my lba, however, with the recent test case and banks beginning to fight this i don't want to be left having to foot any large costs myself at the risk of losing the case.
What would any of you suggest, do i just continue with the court claim or wait until the smoke is cleared? Or would it be worth ringing the bank to try and settle?
Any help would be great as i feel like i'm in limbo at the moment
