Is there anyone out there who can Help?
I used to supply 333 Safeways Stores with a Childrens named note pad. When Morrisons bought them out they withdrew our product since it didn't conform to their store profile.
The issue here is our stands that they refused to return even though our conditions of sale of the pads specifically state that the stand is supplied on a FREE LOAN basis providing that the Client conforms to our conditions of sale or until the contract is terminated. The client agrees to return the stands at their expense.
We had been trading happily with Safeways under our Conditions of Sale for over 4yrs with incident.
After a meeting with one of Morrison’s directors & Safeways Directors, I followed up the next day with a letter stating that they had terminated the contract and would they kindly return all of our stands as per our conditions of sale otherwise I would invoice them.
They only returned approx 20 stands mostly damaged beyond use.
When we realised they were not going to return the stands I invoiced them the standard hire charge of £1.29/day upto the final invoice date + plus the cost of the stands not returned. (70 of the stores had agreed to hire until HQ found out we were asking the Managers if they would like to hire the stands until they had cleared the stock) HQ said that they would not be paying any charges and we must do what we consider appropriate. The total of the stands not returned (Stands alone came to over £14,000) including the hire charges and vat the total came to £96,000+.
They are still refusing to pay and also refusing to say why!
My solicitor tells me that to take them to court would probably cost in the order of £7000+ and take over a year to get them to court, they would also require upfront money, which I do not have.
Is there any Solicitor or Law firm who would take this on a No Win No Fee Basis?

PS It really bothers me that these Giants feel that it's OK to Bankrupt small businesses just so that they make even more obscene profits and they get away with it.

No I'm not a lawyer, thank goodness! It's not like there's a shortage. I studied law as a result of being ripped off more than once(long story)! I have been involved with pursuing companies to help friends and family for many years.
