    Default lucy60 v barclays**WON**

    hi everyone im new to this site and have been reading through it for a couple of days and found it all very helpful. I m at the stage where i have just received my notice of issue from court saying bank will be served on 13 june. back in march when i started with my claim i sent first letter requesting statements waited 40 days and got nothing so sent 14 day letter and they replied with usual fob off letter so sent 7 day letter then filed in court. Have since made complaint to ico as still no statements and made an estimated claim because of this. Im finding this all quite stressful wondering what will happen next and will probably have a few questions of my own soon. Thanks to everyone one on this site who helps people like me.

    sent first letters to customer services at leicester but london address when filed in court all sent recorded delivery I estimated my charges on statements i had covering only three months I have not heard of this filing in court for non compliance of data protection. what is it?

    yes. Filed claim in court last week. Received issue of notice today from court Barclaysicon have until 27 june to reply.

    waited over 70 days for statements before filing claim thought you could do an estimated claim if you had some statements

    i would ring 0800 282 390 and speak to an advisor about your statements .. i would also log a complaint with the information commissionair

    No you can amend your claimicon it does cost you i think £35 which you cant claim back

    have rang bank who first said they never received SARicon until i said i had sent it recorded delivery then they found it and appoligised and said they sent out statements on 29 march which i have not received so they will re send them and i should have them by the weekend. Do i then inform the court that i wish to change amount claiming.

    first of all dont panic, take a deep breath and chill...

    at least you gave them the right amount of notice. What did you put on your claim form? did you copy and paste from this website?

    if so then you can just ammend the claim for the right amount, but wait till your statments are here complete the spreadsheet and see how things are interms of numbers!

    When you say you gave them 7 days notice before filing claim did you tell them you wanted charges back or did you just say you hadnt received the statements?

    it might be better for you to put down everything you have done and details of letter. i think we all need to be sure what has been done.

    thanks for reply am really worried about claim everything seems to be going wrong, firstly sent SARicon waited over 40 days then sent in 14 day letter requesting refund of charges based on estimate of statements i had (3 months worth) multiplied this by time with bank, probably underestimated because charges are now £15 last year were £30/£35. Received fob off letter 10 days later so sent in 7 day letter again requesting back charges or i would go ahead with court action waited 10 days then filed at local court. on claim form I asked for charges plus 8% interesticon, court asked me to add a couple of lines for this. then on particulars of claim i put what is on this site in the templates section. I have since received another letter from bank saying they will contact me again by 9th july. Have I messed up?

    first of all wait for statments to arrive. That form can then be used to ammend you claim. i.e to change amount etc.

    It sounds as if your POCicon are correct, just that you has used an estimate, and have no real proof if it goes all the way to court (this is 99.9999999%) unlikely to happen, but you never can chance it. So just get your statements and work out the real amount first

    seriously, you need to get these statements before you go any further.
    get the right information and amend your claimicon - it will be well worth the cost.
