Default Re Monument Has Been Taken Over, Does This Affect Our Claims?

    Hiya,

Not sure if this thread is in the right place but i'm sure someone can help me. I'm currently in the process of claiming back my charges from my Monument Credit Card but have today received a letter from them telling me that ''Barclaysicon Bank PLC has transferred all its rights under your Monument card agreement to R. Raphael & Sons plc ('Raphaels Bank').'' Is this going to affect how we claim back the charges? I am at the lbaicon stage now and was planning on lodging it against Monument's Registered office address but am not sure now? Do we now have to file against Raphaels?

    kind regards,
    shane

It makes no difference at all. When Raphael takes (took) over Monument they bought all the assets but also inheriticon(ed) all the liabilities. (They are supposed to exercise what is known as 'due dilligence' - I wonder if that included the liability for reclaimed penalty charges.)

But everything should remain the same otherwise. Just carry on the claim as if nothing has happened. The company that runs the card (Monument) is regarded in law as a seperate entity - who owns it is not relevant.

Thanks for the advice Steven, succint and invaluable as always. It would be interesting to see what they say though when roboraver and dolphin939 call them, keep us updated guys!

Just out of interesticon are we all dealing with the same person? My first few letters sent to Monument where replied to by Naomi Wort in customer relations, then when i started sending the prelim and lbaicon I got sent responses by Andrea Evans at the Portland Building address. Are you guys dealing with the same people?

    Hi,
Recieved the same letter today as everyone else, I have sent for statements from Monument to claim charges etc, posted on Saturday, but they do have 40 days to comply in which time the 2nd of July would have passed and Raphaels Bank would have the account. So Monument may not send out the statements as they have passed it over, will watch this thread with interesticon to see how others are getting on

As I said on the other thread, you've sent the request to the right place, after the 40 days it becaomes the problem of the Raphael's data controller
