As to any allegation (if any) that these charges are penalty clauses, they are not. The charges are administrative fees levied by agreement in the circumstances set out above. They are not charged by way of damages for breach of contract. The charges are thus not capable of constituting penalties, and the principles of law in relation to principles of law in relation to penalty clauses have no application.

trouble is that ive gotta get court bundle ready n cant get head round any of it n ive got horrid feelings spontaniously hittin me 24/7 that im gonna get slaughtered if they turn up in court
Well at least you can now look on the 1st August as being being the final date for them to settle, because they sure as hell wont this dragginig through the court so you'll get your payment before then!!

Hi, You dont have to have your bundle in till 2weeks before your date...so try not to worry about that yet..it'll help to keep things organised incase you need it. Try not to get too stressed..i know its easier said !!

it is a relief that the end is in sight but at the same time ive never been so scared! i have to get the court bundle together which reduces me to total brain shutdown. i just think a bit of understanding will help reduce the nightmares...
i know but the problem is im off line at home at the mo and (between you and me) i can only do this on fridays at work! but thank you i feel a bit better .. a problem shared eh?!
HA HA, i know what you mean. If you're concerned about your bundle, the best thing you can do is sort out all your statements, letters from the bank etc..which they have sent you, and get them ready for photocopying. The rest of the stuff you can print off at the last minute.

thankfully ive been copying all that stuff as ive been going along, its all the rest that frighens me to death, but there again each step has terrified me and after ive thought 'is that it?' (hope im not going to eat my words...) its just its getting really technical now and am starting to feel rather illiterate!
