I am currently claiming from Lloyds using this site for help but I am unsure what to do in this situation and can't find the answer!!
I live in Scotland and having sent the request for payment and lba letters, I used moneyclaim to continue with court procedings using a friends address in England.
Lloyds acknowledged my claim but did not enter any defence so I continued with a judgement by default. Just before the 14 days were up before I continued with a warrant I received the a letter from Lloyds solicitors which said:
In the Northampton county court
MR DYLANSSAVINGS v Lloyds TSB Bank plc
Claim number: XXXXX
We refer to the above matter and would advise that our client is unable to locate any account numbers using the address provided on your Judgement order. Please provide the correct Lloyds TSB account number ,including the full sort code, in order that we may take our client's instructions.
We look forward to hearing from you.
Can anyone please advise of what I should do next,as they have not entered a defence should I just continue with the warrant or should I respond to this letter, they clearly know who I am and also know my account numbers but I am wary of issuing a warrant without responding to this letter.
My claim was for more than £1500 (which they have already made a goodwill gesture of £750), which is the reason I used a friends English address.
Any help would be much appreciated, thanks in advance
I think there may be two schools of thought on this one, the more cynical of us may suggest that this is a deliberate ploy to delay the process and give them time to apply to have the judgement set-aside. On the other hand perhaps the solicitors lost your correspondence and need your details in order to satisfy the warrant? I'm not an expert on this process by any means but why not give their solicitors a call? If you have entered into previous correspondence with the bank and you are sure that you provided them with your account details then this is their mistake and i would tell them that you intent to continue with issuing the warrant..hopefully this will prompt them into some action!
Redfaze Vs Lloyds TSB ***WON!!*** Settled out of court for full amount including interest and court costs
I have supplied them with my account number and sort code, I think it is tying it up to my friends address that they are questioning, the only thing about that is that they still managed to send me a letter to MY home address, so they clearly know who I am.
I will give their solicitors a call on Monday morning whilst having my mouse hovering over the submit button on the moneyclaim website to issue the warrant
