    Question Pinkpixie vs Barclaycard

    I'm just in the process of going through all my Barclaycard statements so I can send them an S.A.R letter.
    Do they send all of the statements or just a list of charges?
    Also what is this success rate with claiming with them?
    And finally......
    The account has been passed on over to debt collectionicon agency who I have a re-payment plan with..... can I still claim all the charges back through Barclaycard?

    In the region of 100%

    You need to write to the debt collection agency and inform them that the amount you owe is now in dispute and that they should take no further action. Is the amount you are claiming larger than the amount you owe?

    Angry Pinkpixie is confused?!

    I sent off the first letter to Barclaycard to get all my statements back from them about a week ago.
    Yesterday I received my letter back from them with a compliments slip attached simply saying 'No payment enclosed'.....
    I knew that I had defiantly put the cheque in with it so straight away found my cheque book and I was right I did put a cheque for £10 in the envelope with the letter?!

    What are they playing at?! What should I do next? I can't really afford to keep on sending them cheques especially if they then decide to cash them....

    Probably them just using their standard, now infamous delaying tactics. Maybe I am being cynical and they DID lose it

    I assume the cheque hasn't been cashed yet? Only thing I can think of would be to cancel the cheque, send another one and request that it is in respect of the letter you provided on date xx/xx/xxxx.

    Not sure how you stand with the DP Act though for disclosure withing 40 days. They may state that as no cheque you have to wait another 40 days as if they claim that no cheque was received I do not know exactly what their obligations are under the act in this situation. I'm sure someone else will be able to clarify. Make sure you send recorded delivery too like all the others.

    It's pretty sad that they have to resort to the likes of tactics like this (if they have). Hold on in there and you will get the result you want. I know it's frustrating, Barclaycard and MBNAicon are the two worst I've had to deal with. You have plenty of people here supporting you

    I would say that the 40 days would begin when they received your original SARicon.

    As Animal says send a new cheque, refer them to your original request and then wait out the remainder of the 40 days-they will probably respond to you shortly.

    Won't it cost me though to cancel the cheque?

    Then again that can be added on if/when it goes to court though can't it.....

    Yes...add it to your spreadsheet.

    Keep an eye out for that 'lost cheque' I personally wouldn't cancel it, as you rightly say you will be charged for it.

    My cheque
    And a photocopy of the cheque, they couldnt use this excuse to delay my application, didnt do a lot of good though, been waiting 46 days now, oh and i kept a copy for my files...

    They ignored my last non compliance just as they ignore SARs, they do things as and when they are ready, by the time i get them to court for non compliance i will have had the info im looking for, i think distractions are just adding to the delay...Thanx for advice but a pattern has emerged and i wil wait a bit longer...
