Written by John Kruse, one of the leading experts on Bailiff Law, this consumer friendly guide is essential reading for anyone who comes into contact with a bailiff.
The book is easy to understand and clearly explains the rights
a bailiff has, and also what they cannot do when collecting debts and repossessing goods etc.
20th Jan 07 sent S.A.R. to Barclays.
8th Feb 07 received statements. They also returned my £10 cheque.
9th Feb 07 sent Prelim for £1025.00.
23rd Feb 07 Barclays offered me £535.00 as gesture of goodwill.
27th Feb 07 sent lba.
14th March 07 filed claim with MCOL.
3rd April 07 Barclays acknowledged claim.
17th April 07 Barclays entered defence.
I've already had a successful claim with Halifax who I must say paid up a lot sooner. They paid up 5 days after filing with MCOL.
I am still waiting for a court date, how long does this usually take?
The court dispensed with the aq so I thought that would speed things up but I've been waiting since 17th April. I've rang the court 3 times but they just keep saying its still with the judge and I should hear from them soon.
you could always phone the local court, and just ask them, once they have received the reveral how long ahead are they booking dates for, this will give you a rough guide, if you cant bear the waiting that is.
This is probably one of the worst times, apart from waiting for the money.
As the days just drag. You will get a date soon, i will predict Friday this week, so lets see who is right, me or Daz.
good luck it wont be long now.
Yeah I do hate all the waiting. I've rang the court the last three Fridays to see if theres a court date yet so this time I'll ask how long they are taking, they just keep saying I will hear from them soon. I think I will join in with the predictions and predict Friday next week .
Ambushed the postman again this morning and guess what????
No court date
But on a more positive note I got an email yesterday from Kate who is dealing with my claim (I didnt see it untill today) and she asked if I could email her my SOC's so she could investigate my claim. So I am sat staring at my email inbox waiting for a reply.
Dont hold your breath Penny, I had Kate. She is lovely but not the quickest at replying to emails. However what i would suspect she will do is pass the SOC's onto the accounts dept and they will deal with it from there. You should get a responce from her in the next day or two telling you what is going on though, once she has heard from them.
I could be wrong, but that is what happened to me.
Good luck
As Caz said, she doesn't always return calls when she says.
I also think that you should wait till you get a court date before you contact them.
I got mine sorted a month before the case was due, and I think thats about the limit they are working to at the moment.
OK, I shall drag myself away fom my emails. I was trying not to get too excited but I seem to be waiting ages for this court date. My Halifax claim was 3 months from asking for statements to receiving my money and it's been 5 months already with Barclays. I must have more patience.
Still no court date and still no reply from Kate . I'm thinking about ringing the court again for the 4th time and seeing if it will be much longer cos I've been waiting nearly 2 months. I've read a few threads where they filed on MCOL around the same time as me and they have received court date and been settled by now.
Well I've just rang the court again... and apparently the judge that my claim has been sent to has been on holiday and has just got back today. Why didnt they tell me that last time and it would have saved me the embarrasment of stalking the postman every morning.
They said he will look at it this week and I should hear from them early next week, so it'll be back to postman watch next week.
I still havent received my court date but.... I received a letter this morning from Kate Ashton offering me my money back although it is £9 short cos I dont think she has updated the interest, also I have had another £30 charge so I cant decide whether to ring her and ask for the extra £39.
Which bits do I cross off on the settlement letter it says...
This offer is in Full and final settlement of the whole of your claim and is strictly without any admission of liability on our part. By accepting this offer you also, you also agree that the existence and terms of this offer remain confidential between us.
Do I need to cross out all that or just part of it?
This offer is in Full and final settlement of the whole of this claim
then delete and initial By accepting this offer you also, you also agree that the existence and terms of this offer remain confidential between us.
Also add a ps that you will inform the court when the cleared funds are in your bank
Hope that helps
