I recieved a partial payment from alliance leicester they offered me £900 from £2500
I wrote saying i accepted it but only as a partial payment and i would be continuing with the court claim that is already going through.
It is showing on mcol that they have entered a defence, today i got a letter from wragge and co saying that on the letter from alliance if i accepted the cheque it was Full and final payment and to cancel the court case.
They have got me now, I cant continue with the claim because I have just looked and it did say if I accepted the cheque it was a full and final payment

you told them that it was a partial payment, and are still persuing the claim.i think that would be ok if you havnt used the funds and can still return them if needed .i would write again stating this and show the letter you originally sent.or i would send back the payment and let them know you are still persuing the full amount.or maybe ask a mod for his take on it.hope all is ok for you. good luck chubbs
