I sent off my S.A.R - (Subject access request) request and cheques to various institutions in May. The only one to reply so far is Egg who have sent my cheque back and included their Information Request Form.
I can see that I need to choose option 3 and request the full DSIR but the original 40 days for compliance is due to expire on 24th June and on this form it states it will be another 40 days before I get the info.
My question is do I remind them of the original deadline when I sent the form and cheque back or do I just allow another 40 days to run?
I would say that the 40 days started from the day tnat they received your original request.
Their reply would seem to be a delaying tactic so send the form back to them and remind them that the 40 day clock is still ticking and is soon due to run out.
If they do not respond by the 24th June then send them the non compliance letter as they will be in breach of the Data Protection Act.
