Written by John Kruse, one of the leading experts on Bailiff Law, this consumer friendly guide is essential reading for anyone who comes into contact with a bailiff.
The book is easy to understand and clearly explains the rights
a bailiff has, and also what they cannot do when collecting debts and repossessing goods etc.
lol standard delay tactics, think they are under the impression that if they say that they're dealin with it you will sit and wait. Stick to your schedule hun

yep, I've changed it from "I am very disappointed that you have failed to respond to my letter..." to "I am very disappointed with your response to my letter..."
Blimey A&L are quick! A couple of days later and I've received an offer. It amounts to the difference between what I've been charged and the £12.
My instinct is to reject it, although the amount they've offered would come in handy. What's the general opinion?
'General opinion' at the moment, colheath, would probably be that if you're not DESPERATE for the money you'd be better to go with your instinct and reject the offer.
If everyone starts accepting these low offers just because it's 'easier' then it strenghtens the bank's resolve against the rest of us!
Giving in due to 'financial necessity' is one thing, caving cos it's 'easier' is something else. Keep the faith, dude. 8-)

gosh - thats unusual - did it actully add up to each charge less £12.00 ?
mine was no where near that amount!
Keep reading through our threads here before you decide what to do - each person has their own objectives and needs in respective of the money. As it says on this site - although it is highly unlikely-you must be prepared to appear in court.
Personally i decided to go ahead- but you must make your own decision
on a brighter note there have been lots of cases in all the bank forums settled outside the court in the last few weeks.
Best of luck

What they said in the letter was
we are prepared to refund the sum of £418.00 in Full and final settlement.
This reflects the difference between the amount of charges for unpaid items actually applied to your account and the amount of charges that would have been applied to your account if the charge had been £12
Now, there are 34 charges so @ £12 that makes £408
My actual charge was £1,021 (some were £34, some were £25)
Difference is £613 so they're £195 short.

I'm claiming £1273 for my son and they offered him £281, can't make any of the figures add up, so we've rejected. That was after the first letter, and I don't think there will be any more offers on their way
HFC Bank - First letter claiming £196/LBA sent/£75 offered/rejected/Claim filed
HFC Bank Take 2 - Statements received
A & L - Prelim sent/LBA sent
Barclays (for my Dad) - Awaiting statements/LBA for S.A.R. sent/Statements received/Prelim sent/LBA sent
A & L (for my Son) - Awaiting statements/Statements arrived Prelim letter sent/£280 offered and rejected
Abbey (for my Sister) - ***Won***
Barclays PPI claim
Studio - ***Won***
HSBC - (for my brother-in-law) ***Won*** 8-)
I get the impression that it's not a straight £12 per charge that is being reclaimed, but that they 'pick and choose' which charges they are going to refund, THEN offer £12 for each of these.
I've had a reply back from them, they've carried out a final review of my complaint, a full investigation has been conducted, their position remains unchanged, and I may wish to refer my complaint to the Financial Ombudsman Service.

On with the court claim now then.
Keep up posted and good luck ... we're all here to help
I've received this morning the Acknowledgement of Service from Wragge & Co giving notice of intention to defend, and also a letter from A&L again offering £418 to settle.
Keep going colheath and you'll get ALL your money Though it's totally up to you of course whether or not you continue.
You'll find as time goes on, their offers normally get better and better then, near court stage, they should offer near the full amount. They've just offered me 80% of my claim, but I'm rejecting it as they didn't submit their court papers and hopefully it will be judgement by default if it goes to court in just over a week.
