Hi to everyone,
I bank with llyods TSB and they have kindly decided to defend my claim (June 26th court date set). I would like to know what i should submit to the court and how do i submit it. How do i build a good case if they decide to turn up because knowing my luck they will.
You've definately taken the first step into claiming back what's rightfully yours.
Spend time reading the FAQ's and the Step by Step guide as this will stop you making mistakes along the way. Use the letters and spreadsheets in the templates library as these have all been tried and tested in successful claims. Read as many threads as you can especially ones that relate to your bank. This is a SELF HELP site and won’t do the work involved for you. However, everything you need is on here somewhere.
Don't be afraid to ask any questions, no matter how stupid they may seem, but please remember that any advice that you receive is normally based on experience only and that you should seek expert advice if required.
Once you start the process of your claim remember to open a thread in the relative bank forum, this will enable you, and others helping you, to keep track of your claim.
Hi,
Can somebody give me some advice and answer a couple of questions i have please. I am right at the end of things now. I have a court date on 26th june at Hull court. I heard on the news that a Hull county court judge is considering throughing 20 cases out of court. I have checked and i havent got this particular judge. Lloyds have put in the typical 9 point defence. Should i panic? I have searched this web site and found some really helpful stuff such as the court bundle. My next question is what does it mean by personal info for my case? I have put an effort together for everything i intended to rely on. I purchased a law pack today from this web site. As my court date is fast approaching has anybody got any experince of how long this pack will take to arrive and will it be a massive help to me?
I go on i know. lastly i promise I origanally requested my bank statements using a letter £10 check etc etc. I never needed these as i decided to start my claim using print offs from net. I sent this letter in Jan Lloyds cashed my check in Feb but still now in June they still havent sent me my statements. Can i do anything about this.
If anybody has the time to point me in the right direction or answer even one of my questions it would be greatly appreciated
Hi,
Regarding your statements, you have paid for these to be sent to you...I would either ask for a refund OR contact Andover (Data protection Officer I think) and advise them that they have breached the Data Protection date by not providing within the 40 days....bet you will have them with you within 3 days!! Good luck

Hi there i have almost completed my bundle so this could be useful for anybody just starting to put one together.I have in it so far Witness Statement, Relevent Case Law, Oft report 2006 with section 4.21,BBC news report, orton letter,McNamara interview, Early Day motion, Correspondence, Statements of charges, Scotts Law Commission Report, Australian Default charges report and bits and bats of terms and conditions. I hope this might help somebody but as i am pretty useless on computers cant put in the links. I cant seem to find The Competition Commission report, Data Protection Act Subject access request for manual intervention, Transcript of telephone communication with Lloyds TSB personal banking. I have read on this site these are useful to back up your witness statement. Can anybody point me in the right direction? Can anybody spot something i have missed?
...I cant seem to find The Data Protection Act Subject access request for manual intervention ...
This was the letter that you sent the bank asking for your statements (or list of charges to be precise). If you used the letter from our templates library, of course....
If not, then you don't have this to include in your bundle.

This may be personal - i.e. if you have a transcript, then include it, if you've never recorded a phone call then you won't have one...
Was abit excited on last thread. My last Questios i think. I am going into Hull court to drop off my bundle tomoro. This may sound really thick but i want to get this right. Do i need a covering letter to put in or do i just stick it in a big envolope addressed to the court manager? First page stating claim between myself and Lloyds plus claim number. Also i am going to send another copy of this bundle tomoro to the bank. Do i address this to there solicitors because i have read on another thread to send this somewere else. The address at the bottom of there defence is Sechiari Clark and Mitchell,................ .............. Brighton, East Sussex. And it does state it is an address notices about this case can be sent. I told you this was a thick but dont want to mess this up at this stage. Oh and do i need a covering letter for Lloyds copy of this bundle?
