Written by John Kruse, one of the leading experts on Bailiff Law, this consumer friendly guide is essential reading for anyone who comes into contact with a bailiff.
The book is easy to understand and clearly explains the rights
a bailiff has, and also what they cannot do when collecting debts and repossessing goods etc.
I have recently joined this site to get help with my mum for her bank charges but didnt realise you had all sorts of consumer help wish I had come here before for help would have saved my solicitor bill.
Last year back in July I traded in a Fiat Punto for a Mini Cooper to the above car dealer, this car inturn turned out to be clocked and after 2 weeks of wangling I managed to get another Mini Cooper off the car dealer. He since did a runner without clearing the finance off on my Fiat Punto, owing me/Fiat in excess of £3k.
I've then had problems with Fiat Finance as I had a secured motor loan, which means its not really secured!! Dont ask, and asked if I stopped paying would they claim the car back and was told no. Anyhow I reduced the payments for 6 months with them in which they forgot to mention that it would affect my file (even though I asked on 2 seperate occassions) otherwise I would have struggled on with the two finances.
Well tomorrow is judgement day, my solicitor has not been unable to find the unscrumpulous car dealer (who I hear has a terrible habit of doing this and goes under different names) so under the sales and goods act (I think section 56) the new finance company is jointly liable under anteceeded negotiations. I find out their decision tomorrow so please everyone have your fingers crossed that they see sense before I have to take their sorry arses to court.
Keep you posted
PS Am I allowed to name the car dealer owner and name and shame him?
Well I gave the new finance company until 2 today to make a descision and this has now been and gone so I am now taking them to court. There is absolutely no way I am being messed about by no one, I have already had nearly a year off fighting trying to get my money back and I wont let this one lie.
Oh my god, I was told yesterday that a cheque was winging its way to my old finance company after sending a letter before action. I am so happy that this is all over.
