    Default Notice to pay from county court***WON IN COURT***

    After unsuccessfully writing to get my charges returned to me i took it to the next step and filed a claim thru 'money claim online' i paid a fee of £120
    (amount of claim ; £2996.36 which includes interesticon and £120)

    Lloydsicon TSB have defended my claim and i received a 'notice to tranfer proceedings' dated the 24th May
    Now i have received a 'notice to pay fee' dated 31st May
    which states ;-
    ''your claim was allocated to the small claims track on 31 May 2007. A fee of £100 was payable unless you had made an application for fee exemption or remission. Neither have been received.

    If by 8 June 2007 you have not paid the fee or applied for a fee exemption or remission, your claim will automatically be struck out without further order of the court and you will be liable for the costs which the defendant has inccured''

    this is the first i have heard about any further fee and i have no idea what an exemption or remission is or how i could file one??
    should i pay this £100 ??
    what will happen next ??

    an urgent response would be most appreciated as i only have till Friday to sort this out ..many thanks

    It Is An Allocation Fee And Must Be Paid But Is Added Onto Your Costs And Refunded By Bank If You Win , Lisam

    I took mine out cash on my ltsbicon C/C and then paid the cash to the court.

    Not to be blunt, but you have gone to court without knowing what is going to happen and the process.

    I would suggest a GOOD read of the FAQs as well oas other peoples threads so you know wht to expect.

    If you are Ill prepared you may lose your case.

    You could end up in court having to tell the Judge why you feel these are charges are unfair and refer to the the actual laws.

    hi paul, thank you for your honesty, i do feel very much out of my depth at the moment.. i have been reading thru a lot of the threads today but sometimes that can be even more confusing...
    i would be very appreciative of any help or advice u could give no matter how blunt

    Thats Ok,

    Id rather upset someone and they get their claim correct than not say anything and it go wrong for them

    Anyway welcome to the forum and keep posting your questions and progress and soon you will get the hang of the process.
    Keep reading and you'll be amazed how much knowledge you can amass and the feeling you get at the end when the cheque is in your hand is great.

    hi..i have been reading thru many of the threads and im worried that in none of my correspondance has an allocation questionnaireicon been mentioned?
    am i missing something ?
    is there something i should have sent off... whats this bundle that everyone talks about ??

    i have paid my 100 to continue at local court and had confirmation of payment but that is all....

    i just got a letter off their solicitor today saying that £4.879 has been put into my bank account,,slightly different to your case in the fact they never defended the first court letter and paid up within 2 weeks of the 28 day giving by the court for defaulting.stick at it ,at the end of the day they are robbing us of our money,good luck,paul

    Hey Paul, thank u for the encouragement and congratulations on your victory!!

    Received a ' notice of allocation to the small claims track (hearing)' today..dated 15th June and it reads as follows;-

    District Judge Johnson has considered the statement of case and allocation questionnaire filed and allocated the claim to the small claims track.

    1. claimant do within 21 days of the date of this order, serve a schedule setting out the amount of individual charges, the dates they were applied to the account and the reasons given for such charges.

    2. The hearing of the claim will take place at 14.00 on the 7tyh Aug at Liverpool county courticon and should take no longer than 10 mins.

    The court must be informed immediately if the case is settled by agreement before the hearing date.

    In order to utilise judicial time more effectively this matter has been listed with a number of similar cases.

    ..can someone please clarify exactly what I should do next in layman terms as I don’t want to mess this up ... thank u so much

    Point 1 means they want a copy of your schedule of charges.
    There is no information about submitting a Court Bundle, so I would ring the Court and ask them if you have to.
