Hi l am a little behind everyone else so this probably has been mentioned time before. I wish to claim on my overdraft icon

bank chaeges accumilated over the 6 years icon

but l am affraid of having my bank account, savings account and mortgage icon

closed if l succeed in my claim. Will this/has this happened?

Can someone please put me at ease or tell me of the effects of claiming.

I have just got my letter through the door today awarding me £2080!!!!! They wont be closing my account but they did say if I want to claim in the future they might re-assess my borrowing facility and downgrade me to a basic account.

Hope this helps

PS. There is a not on here somewhere which says its illegal for them to close your account under the Banking Code icon

but I didnt really read it properly so dont take my word on that.

Hi! I have claimed twice now against HSBC icon

and suffered no ill effects. I have now closed my account though, partly just in case they did want to play silly beggars and secondly because I don't want to do business with them. After 12 years of making money out of me and me having to deal with call centres abroad, I have started banking with a Building Society which I can call direct and speak to someone who knows me!!

your account will only be closed if you claim for a second time - mortgage icon

and savings account wouldn't be touched.

have a read of as many threads and faq's as you can so to familiarise yourself with the process of claiming your money back. there's always somebody in the forum to help you should you have any queries/worries.

There's a big story in today's Daily Mail about banks closing accounts where the account holder has challenged bank charges.

In one case it was the account of a youth group in the west country.

The article had a quote from the Financial Ombudsman icon

's Service saying they would take very seriously the issue of banks taking 'retaliatory action' against account holders by closing or downgrading their accounts.

There was the first case of a bank being fined for this (one of the subjects on the front page of the bank charges pages on this site) - It was Alliance and Leicester if I remember.

The banks may try this as a scare tactic to put people off claiming but I think once a few more cases have been heard by the FBO the banks may decide not to pursue this tack.

Who knows.

Just have parachure account ready just in case as they could although as has been said already FSO would not be pleased.

They cannot close your mortgage icon

and why would they want to close your savings.

Dont worry just be prepared.

After I claimed for the 2nd time in respect of our joint account - they closed the account as they said we weren't operating it within their Ts & Cs because we weren't keeping it in credit.

I already had another account open and I think its for the best.

Just to clarify, you think that l will be safe to make 1 claim without my account being closed but to be safe open a parachute account icon

?

If this is so, l will continue with my crusade to claim back my overdraft icon

charges from the might of HSBC icon

Open another account anyway - once you have claimed your charges back it is almost certain that the bank will apply more...your claim will probably take more than a month to settle, and in the intervening time you will find further charges applied...check out "pending charges"...(apologies for any confusion, this actually started off as "Spiceskull - Charges Pending Thread...")

Firstly l apologise for this response for being so general to all who responded but thank you all for your responses and l appreciate all your comments and suggestions. I will now continue with crusade and claim back all money which is owed to me from the might of HSBC icon

Hi guys, just a quick update it is now 14 days since l have sent my Preliminary letter without a response from HSBC icon

. My recorded delivery recorded that it was recieved and signed for. I just hope l sent it to the right person. As it has been 14days l'm about to send my letter before action icon

. Should l wait to hear back from HSBC or send it to the same person as l sent the first? Any help would be great

Yep now time to send the lba icon

. You need to stick to the schedule that you have laid down so that HSBC icon

know that you are serious. The 14 days are up and they have had that time to reply. You will probably get some acknowledgement from HSBC saying that they are investigating but you should ignore that a keep on trucking!!!

Funny enough when l got home yesterday to my amazement l found a letter saying that they have recieved my letter and are investigating the situation. Should l wait to be contacted or still send the lba icon

Is there a disclaimer that can be used when submitting the court claim one line to stop a bank closing your account? I am about to sumit my son's claim via money claim on line. He has written to Natwest icon

twice, deadline ended yesterday and he has not received any acknowledgement.

Just a little update and some questions. I have heard nothing from HSBC icon

since sending my lba icon

(14days ended) so my next step is to file a claim to the courts.
It has come to my attention about compound interest icon

. Is this something l should be claiming for? If so how do l calculate this and what legal ground do l have for claiming this.

Any help would be great
