    Default Mercantile Leeds ... Me too

    Finally got confirmation that we're transferred to Mercantile in Leeds, 28th June.

    Got the order from the court today, dated 25/05/07.

    Case Management Conference on 28/06/07 at 10.30am.

    Says all the usual stuff about all the cases listed (147 of them) being similar and therefore one CMC. They expect many of the cases to have been settled prior to this date therefore allocated half a day. CPR 59 applies. CMI sheet no later than 7 days before hearing. Then the odd bit, last paragraph says;

    "The judge has asked me to point out that amongst the directions that may be given or considered is the allocation of the cases to the multi-track (in accordance with CPR 59) but also it may be appropriate to consider orders for consolidation and directions aimed at selecting which is the most appropriate lead, sample or test case.
    Consideration may also be given to whether it is appropriate to treat this as Group Litigation to which the provisions of CPR Part 19 apply."

    So it looks like it's CMI sheet tonight, email Inga for her comments and pray I'm not the test case but prepare just in case I am.

    think the pages you need are 26, 29 and 31 but can't be sure without looking.

    You should have your terms and conditionsicon booklet from when you opened the account if at all possible as Abbeyicon are referring to it in their defence.

    Then when/if you do have to go further than the Case Management Conference Hearing on 28th you include them in your bundle.

    The Irish & Aus info show that overcharging is a global abuse of position and the t & c can be referred to if Abbey question anything.

    Right, I'm filling in the CMI sheet for the hearing on the 28th and wondered if some whizz out there could tell me if, at Statement of Case point 5, I can ask for full disclosure as per CPR 18, or should I leave out the reference to CPR 18?

    Any advice, VERY GRATEFULLY accepted.

    Hey hey you all!

    It might please you to hear that all the banks except Abbeyicon & ltsbicon were represented at the last Leeds CMC in April.

    It may also really, really please you (if you weren't one of these 'clients'!!) to know that all the cases with these banks were offered full settlements during the day & in the break given for lunch - Yey!

    So here's hoping it goes the same for you...you might notice I was a LTSB one - shame but never mind there's an order saying they have to provide full disclosure by 25th June!!

    Hi, When you say they were represented, do you mean their solicitors turned up for every bank except Abbeyicon & ltsbicon? When i had a merc case in feb, none of the banks solicititors came exept for 2

    Ther is a marked difference between what happened at the Leeds 7th Feb and 26th April hearings.
    At 7th Feb, I believe there were only 2 banks represented at the hearing because only 5 of the 99 cases had not been settled before the hearing. (ie 94 out of 99 cases settled before the hearing).
    In marked contrast, at 26th April hearing, out of the 77 cases listed, only about 40 had been settled before the hearing. Hence there were more cases actually taken to the hearing, and therefore more banks represented at the hearing. See http://www.consumeractiongroup.co.uk...eeds-26th.html posts 63 and 64 etc.
