just sorting out the schedule of charges to send of to court to go with MCOL 1 charge gone over the 6 yrs . we amended the MCOL but its still on the schedule of charges do we cross it off and put accompying letter with it to explain why or do we re -do the list and amend page total to match MCOL.
also another problem ,we always go into our over draught each month will this make a difference to the claim when it gets to court or not
sorry to keep pestering but dont want to muck up anything and jepordise claim at court

i think if the charge was still in date when you first claimed to a & l you can leave it on. If it wasn't i would be tempted to do a new spread sheet and send an ammended copy with a letter to the bank. Just so you know i have absolutely no actual experience with this it is purely my opinion good luck

I think your spreadsheet should match the MCOL claim - and then at the same time send your ammended spread sheet to A&L so everybody is clear about the final amount you are claiming .
I am sending my fianl spreadheet to the Court / A&L registered address and Bootle - as they are the ones who have been replying to letters. I have quoted the MCOL claim numbers on these last spread sheets.
I too am no expert but the fact that you are always overdrawn has no relevance to the argument. We are all aware we have to be charged for not adhering to the conditions of the account - but the fact is that the level of these charges are excessive.
If the banks could prove in court by a Breakdown of charges ithat £34.00 is justified for a computerised letter -we all would have to pay that amount.
