I was thinking of reclaiming my bank charges back from the Halifax but the problem is I also have a mortgage account with them too which I have had a couple of default payments. They have been very helpful and understanding and I feel that if I apply for my charges that they will not be very understanding anymore with my mortgage arrears.
What do you suggest

Your mortgage account is completely separate and as such should not impact negatively as a result of you claiming unlawful bank penalty charges.
Start a thread in the Halifax forum and do some reading up.
