Written by John Kruse, one of the leading experts on Bailiff Law, this consumer friendly guide is essential reading for anyone who comes into contact with a bailiff.
The book is easy to understand and clearly explains the rights
a bailiff has, and also what they cannot do when collecting debts and repossessing goods etc.
You have nurtured me along the way and I need some final preparation. I have been allocated a small claims hearing in my Local Magistrates on Monday 18th June. I have followed all advice until now; ie notices prior to MCOL and nudge after transfering to Local magsitrates.
I was not sent an aq, i phoned and asked usual questions fees etc, but as they were quite tardy over 3 weeks waiting this may be why i just received last week a notice for hearing within 4 weeks. I will follow the advice in "be prepared" and submit bundle to the best of my abilities but am crucially missing TandCs for account opened 1994, will terms from date of claim suffice 2001/2, i dont have this either though.
I will nudge SC&M again and hope the usual settlement arises, but would appreciate help with T&Cs if possible. But even so thanks for website it has steeled my resolve a few times where maybe i would have just settled for the £750 generic offer. Which as usual was paid without notice or acceptance.
I will keep you informed nearer the time. Is there any thing else i need to do, other than prepare bundle, this has to be sent to courts and SC&M before 14 days of hearing right?
kind regards
Brian
ps - Claim is based on 8% interest as simple form included on site, I would share more info ie money etc etc but would prefer to do this when claim is sorted.
Just to finish this thread with another success story, money in Bank today settled in full. Settled 14 days before hearing date, and was a 9 point defence, 8% interest claimed, this information might be of use.
Thanks to GaryH and Bankfodder, their stickys were clear and precise, i didnt need anymore than their guidance, follow them to the letter and you hopefully wont go wrong.
Good luck to all the rest pursuing, they will make you wait and wait but it is worth the wait.
