    Unhappy Lolly1974 V Barclaycard (Help!)

    I sent my preliminary approach for repayment letter to Barclaycard on 17th May, received a letter back today dated 20th May offering to credit my account with £181. (the difference between the £12 fee and the charges I have incured).

    I am now a bit stuck about which letter I send to accept as a partial payment as most of the letters seem to relate to having sent the lbaicon.

    Also am I within my rights to ask for the money back as oposed to having them credit my account.

    Send letter 3.

    Put a bit in saying that you will accept the amount offered as part payment only and that you will pursue them for the balance through the Courts.

    (These are templates only and you need to modify them to suit your own situation)

    They can credit your account.

    You can also stipulate how you want to be paid in your Particulars of Claim. It would be up to the judge to decide if it came to it.

    If you have been defaulted they will pay you out by cheque.
