Response to settlement letter.

Dear XXXXXX XXXXXX,


Thank you for your letter dated 18th May which I received on the 26th of May.

Thank you for the goodwill gesture you have credited my account with.

I respectfully decline your offer as any Full and finalicon settlement and request, once again, that you return to me all charges imposed on this account, totalling the new amount of £870.36

I will accept the sum of £427.00 offered only as part settlement and on the clear understanding that I will pursue recovery of the remainder, with a county courticon claim if necessary.


I will like to add that in your letter you stated that you were prepared to credit my account with the £427. However instead of preparing to refund this to me, you went ahead and did so anyway, and with out the possibility of any interesticon.

With the £427 you have credited to my account I have since closed and credited the remaining balance to my current account and will now only be contacting you via mail and will accept cheque or transfer of funds in any future payment.

Putting the above to one side, I would like to wander away from the standard response letters and advice which have followed to this point and offer my own alternative to this matter hopefully refraining me from pursuing this further in a county court claim and saving us both time.

I will offer you the below proposal on a one time basis only, if you decline I will pursue legal advice and continue with the claim seeking the remains of the original sum, plus any costs occurred including any possible preparation time, which will result in a much higher amount.












My proposal.

My research shows that a generous but educated estimate to your costs due to a contractual breach and subsequent sending of an automated letter costs no more than £2.50 to a maximum of £4.50 per charge, I will offer that for the 54 charges on my account I will accept the deduction ( one time only ) of £2.50 per charge, and as a gesture of goodwill and to hopefully resolve this matter reduce the interest by 25% leaving my one time offer to you at a new total of,

£ 1297.36 – (your goodwill paymenticon) £427 = £870.36
£870.36 – (54 x £2.50) £135 = £735.36
£735.36 – (25% of £222.36) £55.60 = £679.76

The one time offer is for the refund of £679.76

Again, this is a one time offer calculated to save mine, yours and the courts time.

Alternatively if you would like to provide me with the means or evidence to support the £12 cost to you as being realistic to the recovery of the sending of an automated letter, please do so and I may retract my claim if I see fit. And I will also add that the statement from the OFT bears no standing on your responsibility to only recover your costs incurred and not to profit from these charges.

Also, within your letter it does not outline any terms to my acceptance of receiving the balance of £427, only that it is a gesture of good will.

With goodwill in mind, I hope you find my one time offer of a reduced payment to me to save ours and the courts time reasonable enough.
