Should i send my DPA letter to

    Data Protection Team
    Regulatory Compliance
    Abbeyicon House
    201 Grafton Gate East
    Milton Keynes
    MK9 1AN

    With a cheque for £10?

I have read this in another thread, do you think that will be the best bet to get all of my statements?
    And....
I have put in my letter to supply statements since my account was opened, i didnt put a date just put "since my account was opened" is that acceptable?

You don't need statements - you just need a list of charges with dates and amounts.

You may not need to send the cheque.

Phone Anna - in the top of this forum (Abbeyicon contact details).

She should be able to provide you with a list - she did it for me free of charge.

(you could mention that I sued and got my money back - I'l like to let her know that I was right! )

Sorry to be a bit thick about this but do I?

    1. As I don’t know the exact amount send the DPA letter to the Abbeyicon and when I get the records and then………………
    2. When I get a reply from them detailing the charges send the letter and spreadsheet detailing my claim?

    Just merging my two posts.

    Quote from my other post

I'm really depressed now just received my statement i have £145 worth of charges coming out on the 17th which means i cant make my mortgageicon payment i really dont know what to do now....

    -£20 overlimit fee
-£35 for returned Abbeyicon loan direct debiticon
-£30 for visa payment of £1.99
-£30 for visa payment of £1.99
-£30 for visa payment of £1.90

    Total £145.00

I have already worked out my finances for this month to make sure i dont go over drawn and it all adds up if i stick to my budget, which i will but now its all messed up!!

Well i called Abbeyicon this morning, i'm continually getting more and more nervous and stressed each time i call, to the point where i came up with blotches on and around my neck!

Got through and spoke to someone in India, i told him they were very unfair charges and that why are they so high?

He said the charges are valid and he cant refund them and just said that the bank sets the charges at that price.
I mentioned about my "abbey mortgageicon" coming out on the same day and that i couldn't afford to pay it if they took out the charges.
He said well if you have funds in another account then you can transfer the money over???????? does he think i'm stupid i said well if i had the money to transfer over then i wouldn't be calling you would i???????!!

He said he will send me some leaflets about how to take my complaint to higher authorities

So i had to call my abbey mortgageicon and explain to them, they guy said that i will get a default on my mortgage account, which they have never said to me before when I've previously called them to make arrangements

    God i'm so angry

this is just a suggestion - but if I were in the same position, I would remove the money from the account before the charges are taken - don't worry if you incur more charges - you're going to get those back anyway probably with 8% APR tacked on top.

Open a basic accountas fast as possible.

Cancel the DD to Abbeyicon's mortgageicon dept and phone them and tell them that they are going to have to accept a cheque this month - best not to default on a mortgageicon payment.

Give the money for the mortgage to a family member or friend that you trust and get them to write a cheque to Abbey mortgages for you - or even take the cash into a branch to pay it - they probably won't accept this, as it would be helping you out - and if this site has taught me anything it is that banks will do everything in their power to make things difficult, especially if it means that by doing so they 'can' charge more.

Have your wages paid into the new basic account when it is set up and then write the letter asking for the list of charges over the last 6 yearsicon. When you get it, send the 14 day notice letter.

    After 14 days start proceedings.

However, does anyone know if this could affect the mortgage -i.e. could Abbey foreclose because of this?

It would take consderable proceedings to foreclose on a mortgageicon.
Bu best to try and keep the mortgageicon sweet. Nice to have one area of tranquility n your life.

    thanks guys

I will definately open another account, but i dont know about paying my wages into another account just yet because i have a £2400 overdrafticon with them at the moment and they would demand it back if our wages were not going into the account, which i dont think i can handle right now.
I should be able to pay my mortgageicon payment by the end of the month which should hopefully stop any default from showing on the account.

    Just had a reply to the DPA act letter i sent to;
    Abbeyicon house
    201 grafton gate east
    milton keynes
    MK9 1AN

    with a £10 cheque.

    Dear Natasha,

thank you for your letter, which was recieved here on 13th march 2006.
I note that your are requesting a complete list of transactions and charges on the above account number, as well as details about any manual interventionthat may have taken place in relation to your account.

As you are requesting for specific information, Abbey will deal with this without you having to make a request under the data protection act. I have therefore forwarded your letter onto our complaints department for them to deal with and they will be in contact with you in due course. The information will be forwarded to you free of charge and as such i have duly returned your £10 cheque.
If the data you receive does not satisfy your requirements, you still wish to make a Subject access requesticon under the data protection act. I have enclosed an information sheet outlining our procedures.

I trust this meets your requirements.

    Yours sincerely

    Sheena small
    Data protection consultant
They have enclosed a sheet detailing about DPA and a subject access form if i need it.

So does this mean they can take as long as they like now??

    Default Natasha V Abbey

just recieved quite few pages of transactions, etc Breakdownicon only up to 26/7/04 i only found one charge in that lot.
I believe most of the charges come after 26/07/04 to present, so i will wait a few days see if the rest is coming in the post if not i will send them a little reminder. 17 days left remaining

Edit- i should also add i logged on to my internet banking and requested statements from 2002, so this could be a reply to my statement request and not my DPA
