Toucan taking money out of account without authorisation
Hi, I am writing this on behalf of my Mum as she needs a bit of advice. She was with Toucan surf for a little while but they messed up something and they were unwilling to resolve the issue so my Mum cancelled the direct debit and went with another company.
The other day she noticed they had taken £40 from her account for the amount they believe was outstanding on her toucan account.
Are they allowed to do this if the direct debit had been cancelled? I really didn't know the answer, I think she has filed a claim with the bank, I just wondered what people's thoughts were on this?
Re: Toucan taking money out of account without authorisation
Some of these companies have a condition in their T&Cs that as long as you maintain an account with them you must supply a crdit card or bank account
foor them to make regular withdrawals. This they think, gives them the right to override your wishes to cancel the direct debit.
And you might find your bank has more sympathy with Toucan than their own customer. If you are lucky your bank will refund the payment. But in all
likelihood they will check with Toucan first who will insist that there was no mistake and the bank will then refuse to refund.
did Toucan take the amount on the usual day or were they late in calling for
the money. If so you can tell your bank that ithe withdrawal does not even comply with the direct debit mandate that used to exist. You have more
chance of getting a refund if there are two things wrong with the withdrawal.
