    Angry Housing Association - Can I S.A.R?

    Hi,

    Having major problems with my housing association.

    I have rent arrears of £700 and now they are saying that I owe them £3700.

    £3000? Thats a huge difference which no-one can account for. I have no idea where it has come from.

    Is it possible to send them a S.A.R to get my last 6 yearsicon of rent statements?

    Yes, it is possible.

    Because, as an organisation that stores data about individuals, it has an obligation to provide you with whatever information it holds under the Data Protection Act.

    You can go back as far as they have information about you. There are no time limits although a lot of organisations will delete records after a (fairly long) period of time.

    To be successful in court the HA will have to prove that the debt exists, so will have to show you how you accrued the 'missing' £3000.

    When I asked my Housing Ass and Housing Benefit if I could go back to 1999 they were not able to as said there systems had changed. Would this be correct?

    If you were n receipt of a qualifying benefit that would enable full housing and council tax benefit (and there were no non dependants in your property) then get the info from the DWP as proof of a qualifying award, however from October 08 Housing benefit is only backdated for a period of 1 month as opposed to the old 12 month ruling (if good cause was shown).

    Always keep your verification receipt, which you should be given when handing in your H.B and C.T.B forms at your local neighbourhood office, the one you need to keep is the receipt that states all information required has been supplied.
