In about 2002 i had an Egg card, i fell behind with payments so asked to have it converted to a loan because the interest rate was lower. Anyway, when i fell behind with this too, it was sent to Eversheds and then recently passed to Arc.
I sent a CCA to Arc last week. They have sent a copy of my agreement for the loan "from our client as requested". Now i want to make payments (that i can afford) but do i have to do it through ARC who are demanding full payment within the next 7 days? They've not sent proof of ownership of debt, but because Egg has given them instructions to chase it do i have to comply?
Any suggestions/letter templates etc would be much appreciated.
Also, could i S.A.R Egg re original credit card account to claim back charges, even though i don't have the account details for this anymore?
Most certainly you can SAR Egg for both your expired card and current loan, while giving notice you intend to reclaim unlawful charges. I believe Egg will require 2 recent bills to confirm you are indeed yourself, at the address you claim. If you send both to Egg along with £10 requesting full SAR rather than truncated summary, you will get faster response.
Eversheds and other debt collectors always have a bark worse than their bite, and bark more ferociously on the phone than in black and white. I suggest you
(1) Offer to pay what you can monthly, they cannot get blood from a stone.
(2) Give them immediate notice in writing that formal legal procedure is under way, which you know and they know will result in significant reduction of the balance (and arrears) owing. Winners against the Egg are the norm now, rolling off a production line if you do it right, so chin up and good luck.
