We have sent a SAR to Barclaycard and they have responded with copy statements from 2004 onwards. The charges totalled £600 ish. They state that as the other statements are on microfiche they will take up to six weeks to arrive!!
Do we pursue Barclaycard for the £600 now and issue a seperate claim later or do we wait??
Also, are they in breach of the DPA by not providing the full set in 40 days???
Give them about 45 days and then send a letter before action stating they are in breach. Usually does the job although having said that it took 73 days for mine to come!
I sent the first letter for the amount from the statements, but added that I reserved the right to amend this amount when Barclaycard complied with my SAR request and sent me the missing statements. I then phoned Barclaycard, also emailed them and sent in a lba to get my missing statements, by the time I was ready to send my LBA the missing statements had arrived and I amended the amount accordingly.
