HAVE TODAY RECEIVED BANKS NOTICE OF DEFENCE STATING IT IS NAUGHTY TO BE OVERDRAWN ETC AND THEIR DEFENCE IS TO BE THAT ALL THE CHARGES ARE SET OUT IN THE terms and conditions AND THE "CHARGES" ARE A FEE FOR THE SERVICE PROVIDED BY THE BANK. nOW AWAITING THE aq TO COMPLETE..

Do we need to ask for the banks to disclose the workings of the CYNTHESYS system when sending in th aq and Order for Direction - any help gratefully received..
YES, you can add in a little wording into the draft direction with regard to CYNthesis. (Albeit in a business claim, although I have used it in my personal claim.

Can anyone help with regard to the first line of direction order, is the schedule asked for - just a list of charges taken off the bank statements and printed out? If so I supplied these when I sent in my POC to the court would I have to send in another lot..

If so they don't seem to be sending out AQs any more. So its worth sending off the Draft order for Directions as soon as its transferred to your local court.
Hi Zoot not sure what you mean by MCOL!! Have received the YBs defence and am now awaiting aq from the court, I will phone them to make sure they are still sending them. Do I just pick out all the charges and print off a schedule of the charges to send with the direction order or do the need the bank statements proper at this stage. Or do they go in with the court bundle. Mant thanks for your help
Did you do your claim on line or fill in N1 claim form and take it to the court?
You should already have submitted a copy of your schedule of charges. If you've not done this you need to get it off asap. A copy to the court and a copy to Yorkshire.
You keep your actual statements for use in the bundle.
I copied all the charges listing them with dates, reason etc and took them to the court with POC form, so now I need three more lots of copies to send with the aq form have I got the gist of it so far. I have downloaded the basic bundle for the court. I now need the actual statements copied can you help with anything else I need to put into the bundle. I know I wont need them for a while just need to try to get prepared as at the moment I seem to be knee deep in A4 paper. Many thanks don't know how far I would of got with out everybodies help.

Your case is a bit difficult to follow, i see you have started 4 threads.
But yes you have to send a schedule of charges with your court bundle as well as copy statements. I also had to do a statement of evidence to go with the bundle from the template library .
Then when you do your AQ attach the draft order and ask for disclosure of CYNthesys.
There's a list of contents needed for the court bundle with the bundle that you have down loaded, plus in the thread above there is a excellent guide that will help you do your statement of evidence, assuming the judge agrees to the draft order and you can mention CYNthesys in the statement . Hopefully there will soon be a transcript of the whistleblower programme and you can put that in your bundle as well.
Don't worry you will have plenty of time too read up and get your head around things before the court bundle time.
Thanks for that - I have now completed aq included Draft Direction order and also reqested YB disclosure of Cynthesys so now feel confident and will deliver to court and the wonderful Kirstie this week..
I now have a court date and after a brief visit to ebay to stock up on paper and ink, I am now about to attempt my court bundle. Just a couple of questions if anyone can help - do I need the witness statement and should I include a list of settled case's in the bundle. Any help gratefully received.
