    Angry DCA have asked me to pay in full after agreeing to installments

    I defaulted on a credit card last year, and came to an arrangement with their in-house DCAicon that i would pay x amount per month. They accepted this, and confirmed with a letter.

    I missed a payment last month, but as soon as I received the reminder letter from them, I paid it. Therefore all payments are up to date.

    A couple of days ago I received a letter from them requesting payment in full (no mention of the installments) or further action would be taken.

    What do I do now? Does anyone have a letter I can send them reminding them that they agreed to the installments?

    Any help welcome - it's two steps forward and three steps back with my debts at the moment

    It's probably just a computer-generated response letter.... however, you could write (rec. delivery) something like :

    Dear Sir/Madam,

    Re : xxxxx

    Thank you for your letter of xx/xx/2007.

    I have been making regular monthly payments towards the above account for some time. However, my last payment was late in reaching you, due to an oversight.

    This matter has since been rectified and I am therefore writing to confirm that monthly payments will continue as normal.

    Yours faithfully,

    you could also remind them that their action in forcing you to pay in full is viewed as an Unfair practiceicon by the OFT and would warrant an official complaint about their behaviour.

    I've had a similar experience with Alliance & Leicester recently.

    I have written and told them where to go, and sent a copy of their letter where they agreed an arrangement with me.

    I have also CCA'd them as Rory has suggested. I'd go with Rory here and definitely CCA them. Serves them right for being so unreasonable with you.

    Well, I sent them a copy of PriorityOne's letter, and have received a reply back today stating that "we are unable to accept your offer of payment without a full income and expenditure Breakdownicon incorporating other creditors". Failure to reply within 10 days will result in a minimum repayment of x per month (over 8 times what I pay them now)

    What the hell are they playing at???????

    Exactly. Remember these guys have NO particular legal powers they are not bailiffsicon and have no right to enter property or take goods. They just chase people for money and what they want and what they get are two very different things

    I have just started having problems with Robinson Way & Co, they had agreed a 200.00 settlement on a 400.00 debt i asked them to put in writing but they never, when i chased them for it they said its tuff, and that because i had not paid the agreed reduction i would now need to pay 400.00, there csr told me that i because i confirmed the debt owed as part of security check on phone before dealing with the debt the idiot claims that i addmitted to owing the debt, i tried to tell them that the whole debt was 200.00 from Capital Oneicon, and that the rest are illegal charges...... what can i do ?

    You know I always think I will not be amazed by what these DCAs say next but I always am!!

    Oh Boy, in my opinion you should send them a CCA request for the alleged agreement in this matter. Send the request by recorded delivery so that you can track and trace it at a later date. Don't pay them another penny.

    If - and its a big "if" they ARE able to provide you with a properly executed agreement, then I would send an S.A.R. to them to find out what are punitive charges and what is money owed. You can then make a start to claim back the charges.

    However before it goes this far I very much doubt they will be able to provide you with a properly executed agreement (see other threads on Consumer Credit Act Agreements and what they should include to be properly executed) and if they cannot provide this then the alleged debt becomes unenforceable. Have a good read on the forums and you will see many of us are in the same boat. I've not had dealings with Robinson Way myself, but I have seen them nominated as particularly crappy DCAs on more than one occasion.

    Don't be bullied by them - you'll feel much better when you take control, so I would start with the CCA. By the way, refuse to deal with them AT ALL by phone, you want everything in writing from now on.

    Well, well, well

    They continued to refuse my offer of installments, even though I had been paying them 20.00 each month.

    So I CCA'd them and guess what??!! 'It has not been possible to locate these agreements'

    But they look forward to receiving my repayment proposals in order to prevent further recovery action being taken against me

    Guess who's 20.00 a month better off now!!!

    The majority of my debts are more recent, and the creditors have been able to comply with my CCA requests

    But this debt is also one of my largest, so I'm really pleased - A bit of good news for the weekend!
