    I do have a question that hopefully someone might be able to help me with.

    The account I am claiming back the charges for is currently overdrawn entirely due to charges and I can see another unauthorised OD fee being slapped on at the end of the month. Is there anyway I can add that figure to the claim?

    As expected they have stung me for another £40 "unauthorised OD fee" yesterday. They have acknowledged the service of the claim so they have til June 18th. What is the betting I get a letter from them with a cheque on the 17th?

    Thanks for the nice comments.

    Just got a text message from NastyWest asking me to call them urgently.

    It seems my AG account is overdrawn (all charges) and they wanted to discuss repayment terms.

    I pointed out that the balance on that account was currently subject of an on going law suit. Doesn't anyone in at Nasty West talk to one another.

    I would have thought that the legal action would have appeared on the account notes but clearly they don't. The collections department lady said that she was putting notes on my account and passing it back to customer services in borehamwood. As noted above they have till the 18th to cough up or put up.

    Bottom line is should I worry about the collections people?

    Just had a knock on the door - It was the Postie with a Special Delivery letter from RBSicon.

    Inside was the "not comercially viable to fight" letter and a cheque for the full amount inc costs and shy a couple of quid in statutory interesticon.

    Normal conditions apply stop action, not to court publicity, etc...

    As I only got as far then acknowledging the claim can I make a wasted costs order?

    The cheque is payble to me but it say into a/c ( my account number) I really wanted to pay that into my other account the transfer just enough to cover my od and then close the account.

    Does the cheque have to go into the account mentioned on the cheque?

    Dear Ms Hoffmann,

    Re: Claim Number xxxxxxx

    With regard to the above claim and your letter of June 12th 2007, once the enclosed cheque has cleared, I will accept the offer in Full and finalicon settlement and then and only then, contact Northampton county courticon and discontinue the current proceeding.

    However I reserve the right to ask the court to grant me a Wasted Costs order as outlined in the Civil Procedure Rules 27.14(2)(g). This order will cover the full costs incurred recovering my monies, I estimate these costs to be in excess of £150.

    I will be closing my Advantage Gold account as soon as the cheque as cleared.
